CHAPTER 176
(House Bill 322)

AN ACT to repeal and re-enact, with amendments, Section 313 of
Article 66½ of the Annotated Code of Maryland (1964 Supple-
ment), title "Motor Vehicles," sub-title "Operation of Vehicles
Upon Highways," to change the maximum height of a vehicle and
any load thereon permitted on the highways of the Stater AND
RELATING TO CERTAIN DAMAGES RESULTING FROM A
COLLISION BETWEEN A MOTOR VEHICLE AND A BRIDGE
WITH A CLEARANCE LESS THAN 13'6".

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 313 of Article 66½ of the Annotated Code of Maryland
(1964 Supplement), title "Motor Vehicles," sub-title "Operation of
Vehicles Upon Highways," be and it is hereby repealed and re-enacted,
with amendments, to read as follows:

313.

No vehicle including any load thereon shall exceed a height of
13 feet 6 inches PROVIDED, HOWEVER, THE USERS OF HIGH-
WAYS ON WHICH BRIDGES WITH A CLEARANCE OF LESS
THAN 13'6" ARE LOCATED SHALL SAVE HARMLESS THE
OWNERS OF SUCH BRIDGES FROM ANY CAUSE OF ACTION
INSTITUTED AGAINST SUCH OWNERS FOR ANY DAMAGE
CAUSED BY COLLIDING WITH SUCH BRIDGES PROVIDED
SUCH DAMAGE IS THE PROXIMATE RESULT OF THE
HEIGHT OF SUCH BRIDGE OR BRIDGES [12 feet 6 inches
except that motor transport carriers of automobiles including
any load thereon and motor vehicles carry plate and other
flat glass may be 13 feet 6 inches in height. Provided, how-
ever, that nothing in this section shall be construed to prevent
the operation upon any street, road or highway in this State of a
motor vehicle loaded with hay or straw in bound bales and having
an over-all height when loaded not in excess of 13 feet 6 inches].

Sec. 2. And be it further enacted, That this Act is hereby declared
to be an emergency law, necessary for the immediate preservation
of public health and safety and, having been passed by a yea and
nay vote supported by three-fifths of the members elected to each
of the two houses of the General Assembly of Maryland, the same
shall take effect from the date of its passage.
