and to Section 73-65 of the Montgomery County Code (1960 Edi-
tion) , being Articles 17 and 16, respectively, of the Code of Public
Local Laws of Maryland, titles "Prince George's County" and
Montgomery County," subtitle "Washington Suburban Sanitary
Commission," to follow immediately after subsection (c) of said
sections of the respective Codes, providing for the payment to the
Washington Suburban Sanitary Commission of water and sewer
usage charges outstanding against properties taken or acquired by
a public agency, and specifying procedures for the collection and
payment of such sums.
Section 1. Be it enacted by the General Assembly of Maryland,
That a new Subsection (d) be and it is hereby added to Section 83-82
of the Code of Public Local Laws of Prince George's County (1963
Edition), and to Section 73-65 of the Montgomery County Code (I960
Edition), being Articles 17 and 16, respectively, of the Code of Public
Local Laws of Maryland, titles "Prince George's County" and "Mont-
gomery County," subtitle "Washington Suburban Sanitary District,"
and to follow immediately after subsection (c) of said sections of
the respective Codes, and to read as follows:
(d) Whenever the State, county or any municipal corporation,
commission, board, or agency of the State or county, or the Board
of Education of any county, acquires property it shall ascertain if
any bill for water and sewer usage charges are outstanding against
such property and shall see that the bill is paid before it acquires
such property. If the bill is not paid by the property owner prior to
the date of acquisition, the acquiring authority shall deduct the
amount of the bill from the price to be paid to the property owner
and pay the bill amount over to the Commission. If by oversight or
mistake, or for any other reason, the bill for water and sewer usage
charges has not been paid when the acquisition is completed, then
the acquiring authority shall be responsible for the payment thereof
and shall pay the same to the Commission upon demand. As used in
this subsection, the phrase "bill for water and sewer usage charges"
includes the Commission's usual late payment penalty if the same be
applicable to the bill involved.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.
