(1964 Supplement), title "Courts," subtitle "Circuit Court for the
Counties—Court Stenographers," be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

31.

No case at law or in equity shall be docketed in the circuit courts
for Howard, CALVERT, Carroll, Cecil, Kent, Queen Anne's and
Washington counties until the clerk of the circuit court for the ap-
plicable county shall have been paid the initial costs therefor. The
initial costs for docketing an equity case shall be fifteen dollars
($15.00) and for docketing a law case, ten dollars ($10.00). However,
in any such case where the party is indigent and files an oath "in
forma pauperis," this section shall not apply.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.

CHAPTER 163
(House Bill 126)

AN ACT to add new Section 343A to Article 27 of the Annotated
Code of Maryland (1957 Edition and 1964 Supplement), title
"Crimes and Punishments," subtitle "Crimes and Punishments,"
subheading "Larceny," to follow immediately after Section 343
thereof, defining as a misdemeanor certain stealings from coin-
operated machines, and providing a penalty therefor.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 343A be and it is hereby added to Article 27 of
the Annotated Code of Maryland (1957 Edition and 1964 Supple-
ment) , title "Crimes and Punishments," subtitle "Crimes and Punish-
ments," subheading "Larceny," to follow immediately after Section
343 thereof, and to read as follows:

343A.

(a)   Any person who breaks open, damages, destroys, or tampers
with any coin-operated machine, and steals any money or goods
contained therein, shall be guilty of a misdemeanor, and upon con-
viction thereof shall be imprisoned for not more than three years
EIGHTEEN MONTHS, or fined not more than one thousand dollars,
or both fined and imprisoned.

(b)   As used in this section, the term "coin-operated machine"
shall include any automatic vending machine, slot machine, coin-box
telephone, automatic change-making machine, or other receptacle
designed to receive coin or currency in connection with the sale, use,
or enjoyment of property or service. ,
but shall not include any free-
play
pinball machine or free play console machine as defined in Article
56, Section 18 of the Annotated Code of Maryland (1964 Replace-
ment Volume).
