tion in physical plant, therapeutic and laboratory facilities and equip-
ment of such hospitals and which are subject to the provisions of this
subtitle] related institution which is subject to the provisions of this
subtitle and which is in violation of the regulations promulgated by
the Board applicable to such related institutions, shall be guilty of a
misdemeanor, and upon conviction thereof shall be fined not more
than ten dollars ($10.00) for the first offense and not more than
twenty-five dollars ($25.00) for each subsequent offense. Each day
such [hospital] related institution shall operate after a first convic-
tion shall be considered a [second] subsequent offense.

(a) The State Board of Health and Mental Hygiene is hereby
designated as the sole agency to represent the State of Maryland for
the purposes of Part C, Title VI of the Public Health Service Act, as
enacted by Public Law 725 of the 79th Congress of the United States,
and all amendments thereof and additions thereto, providing grants
to states for the construction and reconstruction of hospitals and
related facilities. There is hereby conferred upon the State Board
of Health the powers necessary for it to comply with the provisions
relating to the sole State agency representing the State of Maryland
for the purposes stated in Part C of said Public Law 725 and all
amendments thereof and additions thereto, and contained in any part
of said Title VI of Public Law 725, and all amendments thereof and
additions thereto.
567.
(a) The Governor shall appoint [eleven] twenty-four persons
to an Advisory Council on Hospital Construction to consult with and
advise the State Board of Health and Mental Hygiene in its adminis-
tration of a State plan for the construction and reconstruction of hos-
pital facilities as provided for in said Public Law 725 of the 79th
Congress of the United States.
(b) The term of office of the appointed members of the Advisory
Council [on Hospital Construction] shall be three years [, but of
those first appointed, three shall be appointed for a term of one year,
four for a term of two years, and four for a term of three years, and,
on the expiration of their respective terms, their successors shall be
appointed for a term of three years].
(c) Three members of said Advisory Council [on Hospital Con-
struction] shall be appointed from a list of names submitted by the
Medical and Chirurgical Faculty of Maryland; four members shall
be appointed from a list of names submitted by the Hospital Council
of Maryland, Inc., at least two of whom shall be physicians; one shall
be a person who has been an owner or administrator of a licensed
nursing home within the State of Maryland for a period of not less
than three years immediately prior to the date of appointment and
shall be appointed from a list of names submitted by the Maryland
Nursing Home Association, Inc.; one member shall be a member of
the faculty of a graduate school of public health in the State of
Maryland; [three] twelve members shall be representatives of con-
sumers of hospital services selected from among persons familiar
with the need for such services in urban and rural areas; and [one
member shall be a representative of the State Department of Health
selected by the Board of Health] three members ONE MEMBER
