CHAPTER 800
(House Bill 452)

AN ACT to repeal and re-enact, with amendments, Section 155 of
the Code of Public Local Laws of Howard County (1957 Edition,
being Article 14 of the Code of Public Local Laws of Maryland),
title "Howard County," subtitle "Planning and Subdivision Con-
trol," as last amended by Chapter 774 of the Acts of 1963; relating
generally to the clarification of the definition of the terms "sub-
division" and "street" or "road," and the addition of the definition
of the term "building development."

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 155 of the Code of Public Local Laws of Howard County
(1957 Edition, being Article 14 of the Code of Public Local Laws of
Maryland), title "Howard County," subtitle "Planning and Subdi-
vision Control," as last amended by Chapter 774 of the Acts of 1963;
be and it is hereby repealed and re-enacted with amendments to
read as follows:

155. Definitions:

(a)  The term "Subdivision" means any [the] division of a parcel
of land into [two (2) or more] lots or parcels for the purpose,
whether immediate or future, of transfer of ownership, sale, lease
or building development [, or, if a new street is involved, and division
of a parcel of land]; provided that [in case of] a division of land
into lots or parcels of five (5) or more acres for agricultural or resi-
dential uses only
and not involving a new street shall not be deemed
a subdivision [and may be excepted therefrom by a petition to the
Planning Commission of Howard County]. The term includes re-
subdivision and, when appropriate to the context, shall relate to the
process of subdividing or to the land subdivided. ALSO EXEMPT
FROM THE DEFINITION OF "SUBDIVISION" ARE TRANS-
FERS BETWEEN THE ADJOINING LAND OWNERS FOR THE

PURPOSE OF STRAIGHTENING A BOUNDARY OR BOUNDA-
RIES, AND
, PROVIDED THAT NOTHING HEREIN CON-
TAINED SHALL BE CONSTRUED TO APPLY TO CONVEY-
ANCES BY WHICH THE PARTICULAR GRANTEE THERE-
UNDER ACQUIRES ADJOINING AND CONTIGUOUS LAND
TO THAT WHICH HE ALREADY OWNS, OR TO BONA FIDE
GIFTS OF LAND FROM PARENT TO CHILD OR BETWEEN
OTHER PERSONS WITHIN THE SECOND DEGREE OF RELA-
TIONSHIP.

(b)   The term "street" or "road" means a way for vehicular traffic
of such width, design, construction, and specifications as the Howard
County Planning Commission's master plan (major street plan) and
regulations now require or might hereafter require.

(c)  The term "building development" means the improvement of
land, by annexing to the ground, construction

THERETO OF STRUCTURES for residential, commercial or indus-
trial uses.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.
