to follow immediately after Section 240 thereof, and requiring
certain actions of motor vehicle liability insurers before cancelling
policies.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 240A be and it is hereby added to Article 48A of
the Annotated Code of Maryland (1964 Replacement Volume and
1964 Supplement), title "Insurance Code," subtitle "Unfair Trade
Practices," to follow immediately after Section 240 thereof, and to
read as follows:

Before any policy of motor vehicle liability insurance issued in
this State is cancelled,
OTHER THAN FOR NON-PAYMENT
OF PREMIUM, the insurer shall notify the insured of his possi-
ble right to obtain insurance through the Maryland Automobile
Assigned Risk Plan. Such notice shall clearly explain the pertinent
provisions of said plan, and the prerequisites, procedure, and time
limits for application thereunder, and shall include duplicate appli-
cation blanks in the prescribed form.
SHALL BE IN THE FORM
SET FORTH HEREIN OR IN SUBSTANTIALLY SIMILAR
WORDING. Such notice shall be sent in the same manner and at
the same time as the first written notice of cancellation given or
required by law, regulation or contract.

SEC. 2. AND BE IT FURTHER ENACTED, THAT THE FORM
OF NOTICE SHALL BE IN WORDING SUBSTANTIALLY AS
FOLLOWS: "YOU HAVE BEEN NOTIFIED THAT YOUR IN-
SURANCE COMPANY DOES NOT DESIRE TO CARRY AUTO-
MOBILE LIABILITY INSURANCE FOR YOU ANY LONGER.
YOU SHOULD IMMEDIATELY CONTACT AN AGENT OR
BROKER FOR OTHER INSURANCE OR REQUEST INSURANCE
THROUGH THE MARYLAND ASSIGNED RISK PLAN. THE
ASSIGNED RISK PLAN AFFORDS ELIGIBLE PERSONS THE
RIGHT TO OBTAIN LIABILITY INSURANCE AT A SOMEWHAT
INCREASED PREMIUM. IN ADDITION TO CONTACTING AN
INSURANCE BROKER OR AGENT YOU MAY DIRECTLY CON-
TACT THE OFFICE OF THE ASSIGNED RISK PLAN FOR AN
EXPLANATION." THE NOTICE SHALL CONTAIN THE CUR-
RENT ADDRESS AND TELEPHONE NUMBER OF THE OF-
FICES OF THE ASSIGNED RISK PLAN.

Sec. 2 3. And be it further enacted, That this Act shall take effect
June 1, 1965.
