CHAPTER 777
(House Bill 48)

AN ACT to add new Section 14A to Article 78B of the Annotated Code
of Maryland (1957 Edition), title "Racing Commission," subtitle
"In General," to follow immediately after Section 14 thereof, to
require a percentage of employees of race track licensees in the
State to be residents and citizens of the State and the United States,
with exceptions, defining residence, and relating to employees of
race tracks.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 14A be and it is hereby added to Article 78B of the
Annotated Code of Maryland (1957 Edition), title "Racing Commis-
sion," subtitle "In General," to follow immediately after Section 14
thereof, and to read as follows:

At least eighty-five per centum (85%) of the persons employed each
day by any person, persons, corporation or association licensed to
operate a race track or racing meet in this State shall be citizens of
the United States and residents of the State of Maryland for a least
two years immediately preceding the date of their employment. As
used herein ''residents of the State of Maryland" shall mean persons

who have voted at an election in Maryland within two years prior to

the date of employment and who maintain a permanent place of
residence in Maryland. Each person, prior to such employment, shall
be required to execute and submit to such racing licensees a duly
verified affidavit setting forth his qualifications for employment pur-
suant to the provisions of this section
AND THE RACING LI-
CENSEES SHALL BE ENTITLED TO RELY ON SUCH AFFI-
DAVIT. Jockeys, drivers or apprentices, exercise boys, owners,
trainers,
dockers and governing and managing officials and heads
of departments of the track may be nonresidents of Maryland and
shall be excluded when computing the percentage of resident em-
ployees for the purposes of this section.
THIS SECTION SHALL
BE APPLICABLE ONLY TO EMPLOYEES OF PERSONS, COR-
PORATIONS, OR ASSOCIATIONS LICENSED TO OPERATE
RACING MEETINGS AND SHALL NOT BE APPLICABLE TO
EMPLOYEES OF OTHERS SUCH AS TRAINERS, OWNERS
AND CONCESSIONAIRES.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.
