that the vehicle meets the standards for equipment specified in
Section 406 herein.
(a) Any employee of a State inspection facility who recommends
directly or indirectly that adjustments, corrections or repairs be
made by or procured from a particular business establishment or a
particular person, who issues a certificate of inspection without an
inspection having been made, or who wilfully issues a certificate of
inspection for a motor vehicle, the mechanisms and other equipment
of which do not comply with the standards prescribed by the rules
and regulations established by the Department of Motor Vehicles, is
guilty of a misdemeanor.
4(b) Any person who makes issues, or knowingly uses any imita-
tion or counterfeit or an official certificate of inspection, or who dis-
plays or causes or permits to be displayed upon any motor vehicle
any certificate of inspection knowing the same to be fictitious or
issued without an inspection having been made, is guilty of a mis-
demeanor.
(c) Violation of any of the provisions of this sub-title or of any
regulations promulgated under this sub-title is punishable, upon con-
viction, by a fine not to exceed five hundred dollars ($500) or by im-
prisonment not to exceed six months, or by both fine and imprison-
ment.
SAFETY STANDARDS FOR MOTOR VEHICLES
406.
(A) AS USED IN THIS SUB-TITLE, THE FOLLOWING
WORDS SHALL MEAN:
(B) "REGISTERED DEALER" MEANS A NEW OR USED
CAR DEALER AS THESE TERMS ARE DEFINED ELSE-
WHERE IN THIS ARTICLE.
(C) "MOTOR VEHICLE" MEANS ANY CLASS A PASSEN-
GER NEW OR USED MOTOR VEHICLE, BUT IT SHALL EX-
CLUDE ANTIQUE MOTOR VEHICLES AS DEFINED ELSE-
WHERE IN THIS ARTICLE.
(D) "APPROVED FACILITY" MEANS A MOTOR VEHICLE
GARAGE, REPAIR SHOP OR GASOLINE SERVICE STATION.
(E) "DEPARTMENT" MEANS THE DEPARTMENT OF
MOTOR VEHICLES.
(F) "STATE POLICE" MEANS THE DEPARTMENT OF
MARYLAND STATE POLICE.
(G) "CERTIFICATE" MEANS A CERTIFICATE OF AUTO-
MOTIVE SAFETY STANDARDS ISSUED UNDER THIS SUB-
TITLE.
(H) "DIVISION" MEANS THE AUTOMOTIVE SAFETY EN-
FORCEMENT DIVISION OF THE STATE POLICE.

(A) THERE IS CREATED WITHIN THE STATE POLICE
