(Senate Bill 42)
AN ACT to repeal and re-enact, with amendments, Sections 5 (c),
(d) and (e) of Article 88B of the Annotated Code of Maryland
(1957 Edition and 1964 Supplement), title "State Police," subtitle
"In General," to increase the salaries of police employees of the
Department of Maryland State Police and to change and clarify
the calculation of their longevity pay to exclude the salary in-
creases from such calculations, and relating generally to compensa-

(12) Upon the receipt of proper proofs of the death of a member
who was retired under the provisions of subsection (1) or (3) of
this section on or after July 1, 1965, there shall be paid child's insur-
ance benefits, widow's insurance benefits, mother's insurance benefits,
parents' insurance benefits and lump-sum death payments which are
computed and paid in accordance with the provisions of Title II of the
Federal Social Security Act as in effect at the time of payment, pro-
vided that the average monthly wage upon which such benefits are
based is deemed to be the lesser of one-twelfth the member's average
final compensation or the maximum average monthly wage then in
effect.
(13) Anything in this subtitle to the contrary notwithstanding,
any member whose service is terminated other than by death or re-
tirement after he has rendered twenty or more years of creditable
service may elect to receive a vested retirement allowance in lieu of
the return of his accumulated contributions. The vested retirement
allowance shall be a deferred allowance commencing at the age of 60
and shall consist of:
(a) An annuity which shall be the actuarial equivalent of the
member's accumulated contributions at the age of 60; and
(b) A pension computed as provided under subsection (2) (b) of
this section on the basis of his creditable service and average final
compensation at the time his service is terminated..
Should the member who has elected a vested retirement allowance
request the return of his contributions or die prior to the date when
the first payment of his retirement allowance becomes normally due,
the amount of his accumulated contributions shall be returned and no
further benefit shall be due or become payable on account of his previ-
ous membership.
Sec. 3. And be it further enacted, That it is the intent of the Gen-
eral Assembly that every administrative means available to the De-
partment of Maryland State Police be utilized fully to achieve the
goal of providing a framework within which a young and vigorous
force of State Police can be developed and maintained.
Sec. 4. And be it further enacted, That this Act shall take effect
July 1, 1965.
