CHAPTER 746
(Senate Bill 38)

AN ACT to add new Sections 12B through 12-1, inclusive, to Article
14B of the Annotated Code of Maryland (1964 Supplement), title
"State Boat Act," to follow immediately after Section 12A thereof,
to authorize the creation of Waterways Improvement Districts by
political subdivisions of the State, to provide for the establish-
ment of such districts and the powers of subdivisions and the

State Departments of Chesapeake Bay Affairs and Game and

Inland Fish DEPARTMENT OF CHESAPEAKE BAY AFFAIRS
in relation to such districts, to establish a Waterways Improve-
ment Section within the State Department of Chesapeake Bay
Affairs and to provide for its powers, to provide for financing of
projects within Waterways Districts WATERWAYS PROJECTS
by the State and by subdivisions, and to relate generally to Water-
ways Improvement Districts in the State.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Sections 12B through 12-1, inclusive, be and they are
hereby added to Article 14B of the Annotated Code of Maryland
(1964 Supplement), title "State Boat Act," to follow immediately
after Section 12A thereof, to read as follows:

12B.

(a)   The governing body, as defined herein, is authorized on its
own initiative or otherwise to establish and designate areas of land
and/or water within its jurisdiction as Waterways Improvement
Districts, subject to the provisions of Section 12C.

(b)   The governing body shall act as the district council for the
district and shall have such power and authority in carrying out its
duties hereunder as may be vested by law in it or as may be reason-
ably necessary to carry out its duties.

12C.

The governing body shall refer every proposed district to the
Section of Waterways Improvement of the Department of Chesa-
peake Bay Affairs for a report and evaluation of the benefits to
be achieved by creation of the proposed district. The section shall
review the proposed district and submit a report to the governing
body containing recommendations on the feasibility and need for
the proposed district. The report shall include the area to be in-
cluded within the district, the work or projects to be carried out
within the district pursuant to Section 12F herein and the estimated
costs for the work or projects recommended.

12D.

The Commission on Chesapeake Bay Affairs and the Commission
on Game and Inland Fish are
IS authorized to adopt such rules and
regulations as may be reasonably necessary to carry out the purposes
of Sections 12B through 12-I, inclusive, of this article.

12E.

(a) The Department of Chesapeake Bay Affairs shall be respon-
sible for the following
ADMINISTRATIVE duties in carrying out
the purpose of Sections 12B through 12-I, inclusive, of this article:
