a different contractor, or in which a division of the operation is made
in contracts of amounts less than [$300.00] $200.00 for the purpose
of evasion of this provision or otherwise.

265.

(a) This section shall apply only to home-improvement contracts
between a prime contractor and the owner for work upon one-, two-,
or three-family dwelling places, where the aggregate contract price
exceeds [$300 and some consideration is payable by the owner prior
to completion of the work] $200.00; and where the contractor is
licensed, or is subject to be licensed, in accordance with the provisions
of this subtitle, with regard to the home-improvement transaction.
Contracts which fail to comply with the requirements of this section
shall not be deemed to be invalid solely because of noncompliance.

Sec. 2. And be it further enacted, That this Act shall take effect
May JUNE 1, 1965.

CHAPTER 722
(House Bill 478)

AN ACT to repeal and re-enact, with amendments, Sections 316 (b),
318 (c), 318B (b), 318D (a) and 318D (b) of Article 43 of the
Annotated Code of Maryland (1957 Edition and 1964 Supple-
ment), title "Health," subtitle "State Board of Barber Examiners,"
and to add new Sections 322A, 323A, 323B, and 323C to said Article
and subtitle of the Code, to follow immediately after Sections 322
and 323 thereof, and to repeal Section 2 of Chapter 792 of the Acts
of 1957 and to repeal Chapter 479 of the Acts of 1959, revising
the law relating to qualifications, registration and examination
of barbers; prohibiting the use of certain signs advertising prices
to be charged in barber shops and the use of mobile barber shops;

providing for certain inspection fees for such shops and health

requirements in connection therewith; requiring that every barber
shop shall be separated completely from any other business by
a permanent partition or wall; empowering the Board of Barber
Examiners to make all rules which are reasonably necessary for
the proper performance of its duties and regulations of proceed-
ings; and relating generally to the State Board of Barber Ex-
aminers, the licensing and registration of barbers and the powers,
duties and functions of the Board, applicants and registrants in
connection therewith AND EXCLUDING SOME COUNTIES
FROM THE PROVISIONS OF THIS ACT.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 316 (b), 318 (c), 318B (b), 318D (a), and 318D (b)
of Article 43 of the Annotated Code of Maryland (1957 Edition and
1964 Supplement), title "Health," subtitle "State Board of Barber
Examiners," be and the same are hereby repealed and re-enacted,
with amendments, and that new Sections 322A, 323A, 323B and 323C
