(b) "Explosive composition" means any mixture or substance
which, upon being ignited may cause such a generation of highly
heated [cases] gases that the resulting gaseous pressures are capable
of producing destructive effects on contiguous objects.
(c) "Fireworks plant" means and includes all lands, with build-
ings thereon, used for or in connection with the manufacture or proc-
essing of fireworks.
(d) "Production building" means any building or other structure
in which fireworks are manufactured or processed.
(e) "Storage building" means any building or structure in which
fireworks in any stage of processing, or finished fireworks, are
stored, but in which no processing or manufacturing is performed.
(f) "Magazine" means any building or structure used for the
storage of hazardous chemicals or powders.
(g) "Warehouse" means any building or structure used exclusive-
ly for the storage of inert materials.
(h) "Department" means [State Insurance Department] State
Fire Marshal of Maryland.
(i) "Class A, B, or C explosives" refers to the classes so nomi-
nated and defined by the Interstate Commerce Commission.
16. Permits to discharge or sell.
(a) From and after June 1, 1941, it shall be unlawful for any
person to discharge fireworks without a permit granted in the man-
ner hereinafter provided, or to possess fireworks, either with the in-
tention of discharging or permitting the discharge thereof in viola-
tion of the terms of this subtitle, or for the purpose of disposal or
sale to persons for use or discharge without a permit, where such
a permit is required by this subtitle.
(b) It shall be unlawful for any person to sell fireworks to any
person or persons without a permit issued under this subtitle pro-
vided that nothing in this subtitle shall be construed to prohibit the
sale or delivery of fireworks by a manufacturer licensed by the De-
partment under the provisions of this subtitle to bona fide distribu-
tors, jobbers, or wholesalers whose principal place of business is sit-
uated in a state where the sale and/or possession of such fireworks is
permitted by law.
17. Penalty for violations; manufacturers.
(a) Any person possessing or discharging fireworks in violation
of the provisions of this subtitle shall be guilty of a misdemeanor
and shall be punished for each offense by a fine of not more than
$250.00. Any person selling fireworks in violation of the provisions
of this subtitle shall be guilty of a misdemeanor and shall be punished
for each offense by a fine of not more than $1,000,000; provided,
however, that nothing in this subtitle shall prevent the manufacture
of fireworks or the possession of the materials for the manufacture
of same, or the storage thereof in any warehouse or building main-
tained by the manufacturer of fireworks in the State of Maryland,
nor shall anything in this subtitle prevent any manufacturer of fire-
works from experimenting with pyrotechnics or materials used in
