tions, proceedings to prevent, enjoin, abate, or remove such unlawful
erection, construction, reconstruction, alteration, maintenance or use.
Penalties
13. Penalties.
(a) Whoever knowingly violates any regulations promulgated by
the State Fire Prevention Commission or any provision of this sub-
title, shall be fined not more than $100 or imprisoned not more than
10 days, or both.
(b) Each and every day during which any illegal erection, con-
struction, reconstruction, alteration, maintenance, or use continues
after knowledge or official notice that same is illegal shall be deemed
a separate offense.
Appeals
14. Appeals
(a) Appeals to the State Fire Prevention Commission may be
taken by any person aggrieved by an order or decision of the State
Fire Marshal based upon or made in the course of the administration
or enforcement of the provisions of this Article. Appeals to the State
Fire Prevention Commission may be taken by any officer, depart-
ment, board, or agency of the State and political subdivisions thereof
affected by an order or decision of the State Fire Marshal in the
course of the administration or enforcement of the provisions of
this Article.
(b) The time within which such appeal must be made, and the
effect, form, or other procedure relating thereto, shall be as specified
in regulations promulgated by the State Fire Prevention Commission
in accordance with provisions of the Administrative Procedure Act,
Sections 244 to 256 of Article 41 of this Code, as amended from time
to time.
(c) Any party aggrieved by a final decision of the State Fire
Prevention Commission is entitled to judicial review as provided in
the Administrative Procedure Act, Sections 244 to 256 of Article 41
of this Code, as amended from time to time.
FIREWORKS
15. Definitions.
(a) The term "fireworks" as used in this subtitle shall mean fire-
crackers, squibs, rockets, sparklers, Roman candles, torpedoes, bombs,
grenades, fire balloons, signal lights, and any combustible or explo-
sive composition, or any substance or combination of substances, or
article prepared for the purpose of producing a visible or an audible
effect by combustion, explosion, deflagration, or detonation. The
term "fireworks" shall not include toy pistols, toy canes, toy guns, or
other devices in which paper caps containing twenty-five hundredths
grains or less of explosive compound are used, provided they are so
constructed that the hand cannot come in contact with the cap when
in place for use, and toy pistol paper caps which contain less than
twenty-hundredths grains of explosive mixture, the sale and use of
which shall be permitted at all times.
