(J) THE DEPARTMENT OF TIDEWATER FISHERIES OR
ITS SUCCESSORS SHALL EXPEND FOR THE PLANTING OF
OYSTER SHELLS, OTHER CULTCH OR SEED OYSTERS ON
THE NATURAL OYSTER BARS OR SEED AREAS OR FOR THE
PURCHASE OF NECESSARY EQUIPMENT TO PLANT SAID
MATERIALS AND FOR NO OTHER PURPOSE (1) ALL FUNDS
APPROPRIATED IN THE BUDGET FOR OYSTER PROPAGA-
TION, AND (2) ALL MONIES REQUIRED BY SECTION 716 OF
THIS SUBTITLE TO BE CREDITED BY THE COMPTROLLER
TO THE OYSTER FUND. ANY UNEXPENDED BALANCE IN
THE OYSTER FUND AT THE END OF ANY FISCAL YEAR
SHALL REMAIN IN THE FUND AND BE SPENT FOR THE
PLANTING OF SHELLS OR SEED OYSTERS DURING SUB-
SEQUENT YEARS AND SHALL NOT BE SPENT FOR ANY
OTHER PURPOSE NOR SHALL SUCH MONEYS REVERT TO
GENERAL FUNDS. IN ORDER TO ASSIST IT IN THE PLANT-
ING OF SHELLS AND SEED OYSTERS, THE DEPARTMENT
OF TIDEWATER FISHERIES OR ITS SUCCESSORS SHALL
HAVE THE LICENSED OYSTERMEN SELECT A COMMITTEE
FOR EACH TIDEWATER COUNTY OF THIS STATE OF FIVE
REPRESENTATIVE LICENSED OYSTERMEN, WHO EARN
THEIR LIVELIHOOD BY CATCHING OYSTERS. IN THE
PLANTING OF SHELLS OR SEED OYSTERS IN ANY AREA,
THE DEPARTMENT OF TIDEWATER FISHERIES OR ITS
SUCCESSORS SHALL CONFER WITH AND PROCURE THE
ADVICE OF THE COMMITTEE OF OYSTERMEN FOR THE
COUNTY ADJACENT OR NEAREST TO THE TONGING AREA
TO BE PLANTED. A SIMILAR ADVISORY COMMITTEE OF
FIVE LICENSED DREDGERS SHALL BE SELECTED TO CON-
FER AND ADVISE IN THE PROPAGATION OF OYSTERS
IN THE DREDGING AREAS. IN THE EVENT THAT THE
LICENSED OYSTERMEN OF ANY COUNTY HAVE NOT,
WITHIN THIRTY (30) DAYS AFTER DECEMBER 1, 1961,
FILLED THE INITIAL APPOINTMENTS TO THE ADVISORY
COMMITTEES PROVIDED FOR HEREUNDER, SUCH INITIAL
APPOINTMENTS SHALL BE MADE BY THE DEPARTMENT.
WHERE AN INITIAL APPOINTMENT HAS BEEN MADE, BUT
A VACANCY HAS OCCURRED BECAUSE OF THE MEMBER'S
INABILITY OR UNWILLINGNESS TO SERVE, AND SUCH VA-
CANCY IS NOT FILLED BY THE LICENSED OYSTERMEN OF
THE PARTICULAR COUNTY WITHIN THIRTY (30) DAYS
AFTER THE VACANCY HAS OCCURRED, THE DEPARTMENT
SHALL MAKE THE NECESSARY APPOINTMENTS TO FILL
EACH VACANCY. UPON THE SELECTION OF THE MEMBERS
OF THE COMMITTEES OF TONGERS AND DREDGERS PRO-
VIDED FOR HEREIN AND UPON THE FILLING OF ANY
VACANCY IN ANY OF THE COMMITTEES, THE DEPART-
MENT SHALL PROMPTLY NOTIFY THE MEMBERS OF THE
GENERAL ASSEMBLY FROM THE COUNTY OF THE NAMES
OF THE COMMITTEE MEMBERS SELECTED OR APPOINTED
TO FILL A VACANCY IN SAID COUNTY.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1964.
