AND THE QUALIFIED VOTERS OF THE STATE HAVE
ADOPTED AN AMENDMENT TO ARTICLE 35 OF THE DECLA-
RATION OF RIGHTS TO THE CONSTITUTION OF MARYLAND
PROVIDED IN SUBSTANCE THAT THE POSITION OF
NOTARY PUBLIC SHOULD NOT BE CONSIDERED AN OFFICE
OF PROFIT WITHIN THE MEANING OF SAID ARTICLE 35
OF THE DECLARATION OF RIGHTS. IF, BY JANUARY 1,
1965 THE GENERAL ASSEMBLY HAS NOT PROPOSED AND
THE QUALIFIED VOTERS OF THE STATE HAVE NOT
ADOPTED SUCH AN AMENDMENT TO ARTICLE 35 OF THE
DECLARATION OF RIGHTS IN THE CONSTITUTION OF
MARYLAND, THIS ACT IS NULL AND VOID AND OF NO
EFFECT.

AN ACT to add new Section 707 (e-1) to Article 66C of the Annotated
Code of Maryland (1957 Edition), title "Natural Resources", sub-
title "Oysters and Clams", to follow immediately after Section
707(e) thereof, AND TO REPEAL AND RE-ENACT, WITH
AMENDMENTS SECTION 707 (J) OF THE SAID ARTICLE
AND SUBTITLE OF THE CODE (1963 SUPPLEMENT) to pro-
vide for the temporary closing of natural oyster bars by the Depart-
ment of Tidewater Fisheries with the approval of the oyster
advisory committees and to provide for hearings thereon. AND
TO PROVIDE FOR NOTICE TO MEMBERS OF THE GEN-
ERAL ASSEMBLY OF THE APPOINTMENT OF MEMBERS
OF THE OYSTER ADVISORY COMMITTEES AND THE FILL-
ING OF VACANCIES IN THESE COMMITTEES.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 707 (e-1) be and it is hereby added to Article 66C
of the Annotated Code of Maryland (1957 Edition), title "Natural
Resources", sub-title "Oysters and Clams", to follow immediately
after Section 707(e) thereof, AND THAT SECTION 707 (J) OF
THE SAID ARTICLE AND SUBTITLE OF THE CODE (1963
SUPPLEMENT) BE AND IT IS HEREBY REPEALED AND RE-
ENACTED WITH AMENDMENTS and to read as follows:

(e-1) Notwithstanding the provisions of this section the Depart-
ment is authorized with the approval of the county oyster advisory
committees established under this section to close without the holding:
of a hearing and for a temporary period not to exceed thirty (30)
days any natural oyster bar whenever in the judgment of the Depart-
ment such action is necessary or desirable to increase the productivity
of the bar, provided, however, that procedures for holding a public
hearing prescribed in subsections (c) and (d) shall be initiated within
one week after the temporary closing of any natural oyster bar.
