(5) Creditable service at retirement on which the retirement
allowance of a member shall be based shall consist of the membership
service rendered by him since he last [become] became a member,
and also if he has a prior service certificate which is in full force and
effect, the amount of the service certified on his prior service certifi-
cate.
(6) Notwithstanding anything to the contrary provided in this
article members who held emergency teaching certificates on Septem-
ber 1, 1954, and who thereafter exercised the option of membership
extended to them by the Board of Trustees acting pursuant to its
power set forth in Section 110(6) shall be entitled to service credit
for the service performed by such members while holding emergency
teaching certificates prior to September 1, 1954, provided that they
pay into the System an amount equal to the contributions which
would have been required of them had they been members of the
System while performing such service prior to September 1, 1954.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1964.

CHAPTER 119
(House Bill 28)
AN ACT to repeal and re-enact, with amendments, Section 3(6) of
Article 73B of the Annotated Code of Maryland (1963 Supple-
ment), title "Pensions", sub-title "In General", and to repeal and
re-enact, with amendments, Section 110(7) of Article 77 of said
Code, title "Public Education", subtitle "Chapter 8. Teachers' Cer-
tificates, Salaries and Pensions", subheading "Teachers' Retire-
ment System", adding to the laws concerning former members of
the Teachers' Retirement System who had withdrawn their accu-
mulated contributions and redeposited said contributions with in-
terest, and received service credit for such in the Employees' Re-
tirement System and former members of the Employees' Retire-
ment System who had withdrawn their accumulated contributions
and redeposited said contributions with interest, and received
service credit for such in the Teachers' Retirement System, a re-
striction that these members may not retire within three years
after the date of re-entry in the Employees' Retirement System or
Teachers' Retirement System, respectively.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 3(6) of Article 73B of the Annotated Code of Maryland
(1963 Supplement), title "Pensions", subtitle "In General", and that
Section 110(7) of Article 77 of said Code, title "Public Education",
subtitle "Chapter 8. Teachers' Certificates, Salaries and Pensions",
subheading "Teachers' Retirement System", be and they are hereby
repealed and re-enacted, with amendments, to read as follows:
