ment or judgments rendered against the person or persons on whose
behalf the deposit was made, for damages arising out of the accident
in question in an action at law, begun not later than one year after
the date of such accident, or within one year after the date of
deposit of any security under subsection 3 of Section 124, and such
deposit or any balance thereof shall be returned to the depositor or
his personal representative when evidence satisfactory to the Depart-
ment has been filed with him that there has been a release from
liability, or a final adjudication of nonliability, or a warrant for
confession of judgment, or a duly acknowledged agreement, in
accordance with subsection (e) of Section 123; or after the expira-
tion of one year from the date of the accident, or one year after the
date of deposit of any security under subsection 3 of Section 124,
unless the Department shall have satisfactory evidence that there is
an action pending or that judgment rendered in such action remains
unpaid [.] , or when there is filed with the Unsatisfied Claim and
Judgment Fund Board a notice of intention under Section 154 hereof,
in which case, the filing of said notice shall constitute a lien against
the amount deposited in favor of the board.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.

AN ACT to repeal and re-enact, with amendments, Section 113 (9)
of Article 77 of the Annotated Code of Maryland (1962 Supple-
ment), title "Public Education", sub-title "Chapter 8. Teachers'
Certificates, Salaries, and Pensions", sub-heading "Teachers'
Retirement System", amending and clarifying the law concerning
the acceptance of part-time employment by certain retired mem-
bers of the Teachers' Retirement System.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 113 (9) of Article 77 of the Annotated Code of Mary-
land (1962 Supplement), title "Public Education", sub-title "Chapter
8. Teachers' Certificates, Salaries, and Pensions", sub-heading
"Teachers' Retirement System", be and it is hereby repealed and
re-enacted with amendments, to read as follows:

(9) Acceptance of part-time employment—Notwithstanding any
other provision of law to the contrary, a retired member who is
receiving a service retirement allowance may accept part-time em-
ployment in which all or part of the compensation therefor comes
from State Funds, provided he immediately notifies the Board of
Trustees of his intention to accept such employment and specifies
the compensation to be received therefor and further provided the
retirement allowance receivable by him, computed without optional
modification, plus the annual [rate of] remuneration for the position,
