CHAPTER 268
(Senate Bill 528)

AN ACT to repeal and re-enact, with amendments, Section 425A of
Article 6 of the Code of Public Local Laws of Maryland (1930
Edition), title "Caroline County", sub-title "Plumbing", as such
section was enacted by Chapter 306 of the Acts of 1961, relating to
the Plumbing Board of Caroline County, deleting requirement that
compensation of Board members must be paid from fees of
plumbing license applicants, removing limitation on the amount
of the license and other fees and allowing the Board to establish
the amount of such fees.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 425A of Article 6 of the Code of Public Local Laws of
Maryland (1930 Edition), title "Caroline County", sub-title "Plumb-
ing", as such section was enacted by Chapter 306 of the Acts of
1961, be and it is hereby repealed and re-enacted, with amendments,
to read as follows:

425A. In the discretion of the County Commissioners, there may
be created in Caroline County a Caroline County Plumbing Board,
which shall consist of three members. One of the members shall be a
licensed Master Plumber residing in Caroline County and shall be
appointed annually by the County Commissioners. The remaining
two members of the Board shall be one of the County Commissioners
appointed by said County Commissioners and the Caroline County
Health Officer, none of whom shall receive any additional compensa-
tion for their services under this section. The members of the Board
shall appoint an Inspector of Plumbing, who shall receive such
compensation as shall be fixed from time to time by the Caroline
County Commissioners [, which said compensation shall be paid from
the fees of applicants for certificates or permits, and shall not exceed
the sum or sums so collected. No permit fee for inspection and in-
stallation in any dwelling house or building used for commercial
purposes, not including structures used for manufacturing purposes,
shall exceed the sum of five dollars ($5.00)].

The Plumbing Board shall have the authority and the duty to
create a system of rules and regulations, including the establishment
of fees for inspection, permits and licenses
and submit for adoption
said rules and regulations to the County Commissioners. No speci-
fications made by said Board in any rules or regulations adopted by
it shall exceed those established by the State Plumbing Code. Prior
to the adoption of said rules and regulations they shall be published
once each week for three consecutive weeks in each of the Caroline
County newspapers. The said Commissioners shall provide for a
public hearing on said rules and regulations and shall publish notice
of the day and time of said hearing with the rules and regulations
aforesaid. The purpose of the hearing is to have the Commissioners
obtain the benefit of the public views and opinions prior to final
adoption.

The rules and regulations aforesaid shall have no application,
and the Plumbing Board shall have no authority to control, the
plumbing system of any property owner who shall install or work
on his own plumbing system. Except that the connecting of such a
system to a public water system or public sewer system must be done
