CHAPTER 250
(Senate Bill 329)

AN ACT to repeal and re-enact, with amendments, Sections 60 (e),
151, 153, 159 (c), 159 (d), 159 (e), 159 (f), 159 (h) (1), 168,
and 175 (a) of Article 2B of the Annotated Code of Maryland
1959 1957 Edition and 1962 Supplement), title "Alcoholic Bever-
ages", sub-titles "Procedure for Issue of Licenses", "Boards of
License Commissioners", "County Liquor Control Boards and Dis-
pensaries", and "Appeals"; to repeal Sections 63 (g), 155 (g),
and 157 of said Article and sub-titles; and to add a new Section
164 (a-½) to said Article, sub-title "County Liquor Control Boards
and Dispensaries", to follow immediately after Section 164 (a)
thereof, creating a Liquor Control Board for Caroline County,
specifying generally its composition, powers, and duties, and relat-
ing generally to the sale and distribution of alcoholic beverages
within Caroline County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 60 (e), 151, 153, 159 (c), 159 (d), 159 (e), 159 (f),
159 (h) (1), 168, and 175 (a) of Article 2B of the Annotated Code
of Maryland (1957 Edition and 1962 Supplement), title "Alcoholic
Beverages", sub-titles "Procedure for Issue of Licenses", "Boards
of License Commissioners", "County Liquor Control Boards and Dis-
pensaries", and "Appeals", be and they are hereby repealed and
re-enacted, with amendments; that Sections 63 (g), 155 (g), and
157 of said Article and sub-titles be and they are hereby repealed;
that a new Section 164 (a-½) be and it is hereby added to said
Article, sub-title "County Liquor Control Boards and Dispensaries",
to follow immediately after Section 164 (a) thereof, and all to read
as follows:

60.

(e) In Caroline County, before the license is issued, [the County
Commissioners of Caroline County, acting as] the [said] board of
license commissioners [,] shall satisfy themselves of the moral char-
acter and financial responsibility of the applicant, the appropriate-
ness of the location where such licensed business is to be conducted,
taking into consideration the number of licenses already issued, and
generally as to the applicant's fitness for the trust to be reposed.

63.

[(g) In Caroline County the expenses incident to the work of
issuing alcoholic beverages licenses shall be paid by the County Com-
missioners from the funds arising from license fees.]

151.

The respective boards of county commissioners shall ex officio con-
stitute the boards of license commissioners in ([Caroline,] Carroll,
Cecil, Dorchester, Garrett, Howard, Kent and Worcester counties.

153.

In Harford County and in Caroline County, the liquor control
board is hereby declared to be a State agency to administer the
