For the reasons stated in a letter of even date, respecting the legal
sufficiency of House Bill 192, copy of which letter is attached hereto,
it is the opinion of this office that House Bill 204 fails to meet the
requirements of Articles 15 and 23 of the Declaration of Rights and,
therefore, is unconstitutional. This bill contains language identical to
that language of House Bill 192 upon which we based our opinion
that that bill is unconstitutional.

House Bill No. 213—Reimbursement from Relatives for
Public Welfare Payments
AN ACT to add a new AN ACT TO ESTABLISH THE PRO-
CEDURE BY WHICH THE STATE DEPARTMENT OF PUBLIC
WELFARE SHALL SEEK RE-IMBURSEMENTS FROM LEGAL-
LY RESPONSIBLE RELATIVES FOR PAYMENTS MADE BY
THE COUNTY DEPARTMENTS IN CERTAIN CATEGORIES
OF PUBLIC ASSISTANCE, BY ADDING A NEW Section 15A to
Article 70A of the Annotated Code of Maryland (1957 Edition),
title "Old Age Assistance," to follow immediately after Section 15
thereof, providing that any child of an applicant for or recipient
of old age assistance who is financially able to contribute to a
reasonable subsistence of the applicant or recipient is obligated to
do so, and relating generally to the determination of such ability
and the payment, and collection of the obligation by the Collection
Unit now operating as such for the Department of Mental Hygiene
and the State Department of Health; AND BY ADDING A NEW
SECTION 7A TO ARTICLE 88A OF THE ANNOTATED CODE
OF MARYLAND (1957 EDITION) TITLE "STATE DEPART-
MENT OF PUBLIC WELFARE" TO FOLLOW IMMEDIATELY
AFTER SECTION 7 THEREOF, AUTHORIZING UNDER CER-
TAIN CIRCUMSTANCES THE ESTABLISHMENT BY REGU-
LATION OF SIMILAR PROCEDURES WITH REFERENCE TO
PUBLIC ASSISTANCE TO THE NEEDY BLIND AND TO THE
PERMANENTLY AND TOTALLY DISABLED.
