the necessity for such appointment shall occur. If for any reason
any person or persons drawn as a grand juror or grand jurors shall
fail to attend and be present or be disqualified or excused for cause
the court shall forthwith proceed to fill such vacancies from the
aforesaid remaining number of names of those who are present and
may thereupon in its discretion fill such vacancy or vacancies thus
made in the petit jury by drawing the necessary numbers of addi-
tional names therefore in manner provided by Section 10A of this
article.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.

CHAPTER 892
(Senate Bill 609)

AN ACT to add a new Section 212(e) to Article 89B of the Annotated
Code of Maryland (1957 Edition and 1962 Supplement), title
"State Roads", sub-title "Convict Labor", to follow immediately
after Section 212(d) thereof, providing for Somerset County and
the municipal corporations therein that the Board of Correction
under certain circumstances shall supply prisoners to do work on
projects for the development, improvements, and maintenance of
public areas and of parks and recreation areas.

Section 1. Be it enacted by the General Assembly of Maryland,
That a new Section 212(e) be and it is hereby added to Article 89B
of the Annotated Code of Maryland (1957 Edition and 1962 Supple-
ment), title "State Roads", sub-title "Convict Labor", to follow im-
mediately after Section 212 (d) thereof, and to read as follows:

(e) At the request of the Board of County Commissioners of Som-
erset County or of the Mayor and City Council, by whatever name
known, of any municipal corporation in Somerset County, the Board
of Correction to the extent of reasonable availability shall supply
such prisoners to work on projects for the development, improvement,
and maintenance of public areas and of parks and recreation areas
in the county or municipality. Such employment shall be under and
subject to the provisions of subsection (b) of this section.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.

AN ACT to repeal and re-enact, with amendments, Section 37 (r) of
Article 87 of the Annotated Code of Maryland (1962 Supplement),
