be and they are hereby repealed; and that new Sections 441 to 449,
448, inclusive, be and they are hereby enacted in lieu thereof, to
stand in the place of the Sections so repealed and to be under the
new sub-title "Roads and Public Works", and to read as follows:

Roads and Public Works
Powers and Duties of County Commissioners

441(a) The County Commissioners of Harford County shall con-
struct and maintain the county road system, with full responsibility
for county roads, streets, highways, alleys, parking areas, storm
water drains, curbs and gutters, bridges, street lighting, roadside
maintenance and beautification, and all matters pertaining thereto.
The Commissioners may construct or assume control over the mainte-
nance of sidewalks as part of the county road system.

(b)  The Commissioners have full power and authority to open,
close, plan, construct, maintain, repair, improve, protect, preserve,
alter, relocate, straighten, widen, rebuild, beautify, and, in general,
to control all bridges, highways, roads, sidewalks, alleys, storm water
drains, and such other facilities and appurtenances as they deem
necessary or advisable in conjunction with the establishment and
continuance of any efficient county road, bridge, sidewalk, and storm
water drainage system.

(c)  The Commissioners may acquire property for any of the
purposes of this sub-title by purchase, gift, devise, bequest, exchange
or condemnation, including such land and buildings as may be
necessary for administrative and maintenance purposes. The right to
acquire by condemnation shall be exercised under the provisions of
Article 33A of the Annotated Code of Maryland (1957 Edition and
any amendments thereto). The power of condemnation herein con-
ferred shall not be extended to include any property dedicated as a
cemetery.

(d)   The Commissioners may sell any and all land belonging to
the county which has been or may hereafter become unnecessary for
use by the county for road purposes by reason of the construction,
improvement, or relocation of state or county roads in Harford
County. Such land may be sold at such prices and upon such terms
as the County Commissioners determine, provided the prices and
terms are fair and reasonable; and the Commissioners shall give a
good and sufficient deed to the purchaser or purchasers of land so
sold. The proceeds derived from the sale thereof shall be deposited
with the County Treasurer, to be disposed of as by law directed.

(e)  The Commissioners may adopt reasonable rules and regulations
governing the width, proper care, repair, improvement, construction,
and maintenance of county roads, bridges, sidewalks, parking areas
and other appurtenant structures, and may adopt regulations with
reference to the use of the county roads, streets, and highways by
public utilities, corporations, individuals, and the traveling public.
Such regulations, if adopted, shall include a proper protection of the
roads and other appurtenances of the county highway system and
shall impose reasonable penalties for a violation and make other
necessary provision for the enforcement thereof; and the rules and
regulations may include the use of and reasonable ways
