(h) The Governor may remove any member of the Council for
inefficiency, neglect of duty, or misconduct in office.

(Powers and Duties of the Council).
The Council is hereby authorized to:
(1) Formulate and recommend to the Board rules and regulations
for the control of air pollution, only at the request of the Board or
the Commissioner of the Department.
(2) Recommend to the Board the amendment or repeal of any
rule or regulation.
(3) Review the policies and program of the Board with respect
to air pollution.
(4) Consult with and advise the Board on matters relating to
air pollution.
(5) Hold hearings as herein provided.

(Authority of Board in Cases of Emergency).
Whenever the Board finds that an emergency exists requiring im-
mediate action to protect the public health or welfare, it may issue an
order reciting the existence of such emergency and requiring any such
action be taken as it deems necessary to meet the emergency. Such
order shall effective immediately. The officer requiring such
emergency action shall be held immune from civil action when act-
ing pursuant to the intent of this Section.

(Right of Entry—Secret Processes).
When in discharge of the responsibilities of the Department under
this subtitle, personnel designated by the Commissioner of the De-
partment shall have the right of entry MAY, WITH THE CONSENT
OF THE PROPERTY OWNER, HAVE ENTRY at all reasonable
times to all property, real and personal, and shall be empowered to
MAY inquire into and receive information as to any device, process,
material, and any other fact deemed necessary by such designated
personnel for evaluation of the condition. IF THE PROPERTY
OWNER REFUSES TO CONSENT TO THE ENTRY THE CIR-
CUIT COURT OF ANY COUNTY IN WHICH ALL OR ANY PART
OF THE PROPERTY IS LOCATED OR THE BALTIMORE CITY
COURT, IF ALL OR ANY PART OF THE PROPERTY IS LO-
CATED IN BALTIMORE CITY, MAY, UPON PETITION OF THE
DEPARTMENT AND FOR GOOD CAUSE SHOWN, ISSUE AN
ORDER GRANTING SUCH RIGHT OF ENTRY ON SUCH TERMS
AND CONDITIONS AS THE COURT MAY DEEM APPROPRI-
ATE. Any information relating to secret processes or methods of
manufacture or production disclosed to, or required, ascertained or
discovered by, any inspector or other employee of the Department
shall be subject to the provisions of subsection (d) of Section 699 698
hereof.
