AND THEREBY LOWER THE MINIMUM REQUIREMENTS OF
SUCH MUNICIPALITY, COUNTY OR LOCAL BOARD OF
HEALTH.

(Creation of Air Pollution Control Council).
(a) There is hereby created, as an agency of the State, an Air
Pollution Control Council consisting of five (5) members, all of whom
shall be appointed by the Governor. One of said members shall be
appointed from a list of three (3) names submitted by the Baltimore
Section of the American Society of Mechanical Engineers, one of
said members shall be appointed from a list of three (3) names sub-
mitted by the Maryland Section of the American Institute of Chemical
Engineers, and two of said members, who are at the time employed
by persons carrying on a manufacturing or public utility business
within the State, shall be appointed one from each of two lists of
three (3) names submitted by the Baltimore Association of Com-
merce. Each of said members shall be experienced and competent in
maters of air pollution control. The remaining members MEMBER
shall be a doctor of medicine and shall be appointed from a list of
three (3) names submitted by the Board.
(b) Each member shall be appointed for a term of five (5) years
and shall serve until a successor is appointed and qualified; provided,
however, that of the first appointees, one shall hold office for a period
of one year, one shall hold office for a period of two years, one shall
hold office for a period of three years, one shall hold office for a period
of four years AND one shall hold office for a period of five years.
(c) Upon the expiration of the term of any member, a successor
shall be appointed in the manner hereinabove provided from the ap-
propriate list of three (3) names. A member shall be eligible to
succeed himself from time to time, provided his name is on the list
submitted to the Governor.
(d) Vacancies on the Council, through death, resignation or re-
moval, shall be filled for the unexpired term in the manner herein-
above provided from the appropriation APPROPRIATE list of three
(3) names.
(e) Three (3) members of the Council shall constitute a quorum
authorized to transact any business, perform any duties or exer-
cise any powers of the Council except as is hereinafter provided.
(f) The members of the Council shall receive no compensation for
their services as members, but shall be repaid for actual expenses
incurred in the performance of their duties under this subtitle.
(g) The Council shall meet and organize by the election of a
Chairman and Secretary who shall serve for the year for which they
are elected. The Secretary need not be a member of the Council, and
shall serve without compensation, but shall be paid for actual ex-
penses incurred in the performance of his duties under this subtitle.
The Council shall meet at such times and places as may be specified
by call of the Chairman, the Board or the Governor.
