CHAPTER 798
(House Bill 829)

AN ACT to repeal and re-enact, with amendments, Section 16-40 of
the Anne Arundel County Code (1957 Edition and 1961 Supple-
ment) , being Article 2 of the Code of Public Local Laws of Mary-
land (1930 Edition), title "Anne Arundel County," subtitle
"Police," adding a category to those persons who qualify to receive
a deceased policemen's pension benefits in Anne Arundel County.,
MAKING THIS PROVISION RETROACTIVE AND ALSO PRO-
VIDING A PENSION TO GUSTAV H. FAUBERT.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 16-40 of the Anne Arundel County Code (1957 Edition
and 1961 Supplement), being Article 2 of the Code of Public Local
Laws of Maryland (1930 Edition), title "Anne Arundel County,"
subtitle "Police," be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

16-40.

The benefits provided in this subtitle shall be due and payable in
the event of the death of a member, either before or after his retire-
ment as follows:

(1)   To his widow, if any there be, until her death or remarriage.

(2)   If there be no widow surviving, then to the child or children
of the deceased member until such child or children reach the age
of eighteen.

(3)  If there be no widow surviving or no children surviving under
the age of eighteen,
THEN to a sister of the OF ANY deceased mem-
ber, under extenuating, among which shall be included his support
WHO HAD BEEN THE PRINCIPAL SOURCE OF SUPPORT of her
prior to his death and his maintaining
WHO HAS MAINTAINED his
residence in her home prior to his death.
THE BENEFITS CON-
FERRED UNDER THIS SUBSECTION SHALL BE PAID TO ANY
PERSON QUALIFYING THEREFOR UNDER THE TERMS OF
THE PRECEDING SENTENCE WITHOUT REGARD TO THE
DATE OF DEATH OF THE DECEASED MEMBER.

[(3)] (4) In the event a member or a widow of a member to whom
a pension allowance would be paid is appointed to any position
in any department of the county, the pension allowance shall be
suspended during the period of such employment.

SEC. 2. AND BE IT FURTHER ENACTED, THAT A PENSION
OF $75.00 PER MONTH SHALL BE PAID TO GUSTAV H. FAU-
BERT FOR THE REMAINDER OF HIS NATURAL LIFE.

SEC. 2 3. And be it further enacted, That this Act shall take effect
June 1, 1963.
