factured for sale, stored, or dispensed in any size packages or con-
tainers not to exceed half-gallon packages or containers and said
packages or containers shall be plainly and distinctively labeled "Ice
Milk" in letters as large as the largest letters on said package or
container. Ice milk may be drawn from a freezer and each freezer
must be plainly marked "Ice Milk," in a manner conspicuous to the
public, in letters at least three inches (3") in height. Ice milk shall
not be dispensed or sold from packages or containers for any use
whatsoever. "Dispensed" shall mean dipping, scooping, or breaking
of packages or containers.
(ii) Artificially sweetened ice milk means the pure, clean, frozen
products made from a combination of milk products, sorbital, cycla-
mate calcium, saccharin, non-nutritive artificial sweeteners, and/or
other harmless, non nutritive edible carbohydrates for use only by
persons who must restrict their intake of ordinary sweets with or
without harmless coloring, and with or without added stabilizer or
emulsifier composed of wholesome edible material. It shall contain
not more than one half of one per centum by weight of stabilizer
and not more than one fifth of one per centum by weight of emulsifier,
not less than ten NOT LESS THAN FOUR PER CENTUM NOR
MORE THAN SEVEN per centum by weight of milk fat, and not less
than eleven per centum by weight of total milk solids. In no case shall
any artificially sweetened ice milk weigh less than four and one-half
pounds per gallon and contain less than one and three-tenths (1.3)
pounds of total food solids per gallon.
(iii) Subject to the standards provided by law or prescribed by
rules or regulations by the State Department of Health pursuant
thereto, any person may manufacture or prepare artificially sweet-
ened ice milk, containing an artificial sweetening agent approved by
the State Department of Health. The manufacturer shall place the
artificially sweetened ice milk only in pint packages or containers
which shall be conspicuously labeled, "artificially sweetened" im-
mediately preceding the words "ice milk," in similar type at least
one-half the size of the type use for the words "ice milk" and on the
same contrasting background, and in addition shall label thereon
"intended for diabetics under medical advice" and any other warning
statement which the State Department of Health may prescribe.
The label shall also contain a statement in terms of percentage by
weight of protein, fat and carbohydrates, the total number of calories
per ounce, the number of calories contributed by carbohydrates and
any carbohydrates other than lactose, and the name of each ingredi-
ent entering into the composition other than flavors. The artificially
sweetened ice milk shall not be sold in any quantity or in any manner
other than in a sealed or unbroken pint package or container.
(g) (i) "Stabilizers" or emulsifiers are pure edible gelatins or
vegetable gums or any other wholesome edible materials and in such
amounts as may be approved by the State Board of Health.
(ii) "Artificial sweetener" is a pure edible product which is made
synthetically and has no calorie value. Provided, that nothing con-
tained in this definition shall be construed as barring any artificial
sweetener other than those mentioned in this law, which has been
demonstrated to be equally as efficient and which has been approved
by the State Health Authority BOARD OF HEALTH AND MENTAL
HYGIENE.
