or opened, or the counters exposed, except by the action of the proper
custodian of voting machines for good and sufficient reason, state-
ment of which shall be made in writing and signed by him and at-
tested by the signatures of the judges of election, or except upon the
written order of the board of supervisors of elections for good and
sufficient reason which shall be stated in the order. In Allegany
County no repairs or adjustments shall be made to any voting ma-
chine during an election unless made by a custodian or deputy cus-
todian, for good and sufficient reason and a complete statement shall
be prepared for each repair or adjustment made. Such statement
shall contain information as to the repairs made, the reason for the
malfunction of the machine, the duration of the period of time
that the machine is out of order and shall be filed as a permanent rec-
ord, the original in the custody of the board, one copy to the custodian
and one to one of the attesting judges.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.

CHAPTER 737
(House Bill 746)

AN ACT to repeal and re-enact, with amendments, Section 123 of
Article 33 of the Annotated Code of Maryland (1957 Edition), title
"Elections," subtitle "Voting Machines," providing additional re-
quirements for custodians and deputy custodians of voting machines
in Allegany County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 123 of Article 33 of the Annotated Code of Maryland
(1957 Edition), title "Elections," subtitle "Voting Machines," be and
it is hereby repealed and re-enacted, with amendments, to read as
follows:

123.

The board of election supervisors shall appoint a custodian of vot-
ing machines and a deputy custodian whose duty it shall be to prepare
the machines for use. The custodian and deputy custodian shall be
appointed respectively from each of the two leading political parties
and their compensation shall be fixed by the board of election super-
visors. In Allegany County each custodian, after assuming his office
shall take a training course in the operation and repair of voting
machines at the factory of the manufacturer of the machines used;
and each deputy custodian shall take a training course in making
minor repairs to such machines as soon as possible after assuming his
duties.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.
