authority in respect to each housing project in lieu of taxes; or
(b) a sum, if any, which said city or political subdivision has agreed
to accept in respect to a project or projects in lieu of taxes; provided
further,] In lieu of such taxes and special assessments, an authority
shall make payments to the city or political subdivision of the State
in which a housing project is wholly or partly located in such amount,
if any, as may be set by mutual agreement between such authority
and city or political subdivision of the State; provided, however, that
the sum to be paid to the city or political subdivision shall not exceed
an amount equal to the regular taxes levied upon similar property.
In the event that an authority, set up under the provisions of this
article either by a city or a county, takes over the federal project
in Prince George's County, known as Greenbelt the provision of
this article limiting the amounts payable in lieu of taxes shall not
apply and such payments shall be subject to agreement between
such authority and the public body involved.
Sec. 2. Be it further enacted, That Section 5 of Article 44B of the
Annotated Code of Maryland (1957 Edition and 1962 Supplement),
title "Housing Cooperation and Aid," be and it is hereby repealed
and re-enacted, with amendments, to read as follows:
Article 44B
5. Provisions for payment by authority to State public body.
[Any State public body may (a) fix a sum which is to be paid to
it annually by the housing authority in respect to each housing
project in lieu of taxes; or (b) agree that the housing authority
shall not pay or be liable to pay any sum whatsoever in respect to
a housing project or projects for any year or period of years; or
(c) agree with a housing authority of the federal government upon
the sum to be paid by the housing authority for any year or period
of years in respect to a project or projects, or accept or agree to
accept a fixed sum or other consideration in lieu of taxes; provided,
however, that the sum to be paid to the city or political subdivision
shall not exceed an amount equal to the regular taxes levied upon
similar property.] In connection with any housing project of a
housing authority located wholly or partly within the area in which
any State public body is authorized to act, any State public body
may agree with such housing authority for the payment to it by
the housing authority of such sums in lieu of taxes, if any, for any
year or period of years as may be set by such agreement.
Sec. 3. And be it further enacted, That this Act shall take effect
June 1, 1963.
