the same contrasting background, and in addition shall label thereon
"intended for use in carbohydrate restricted diets only" and in capital
letters "Not Low Calorie"
INTENDED FOR DIABETICS UNDER
MEDICAL ADVICE and any other warning statement which
the State Department of Health may prescribe. The label shall also
contain a statement in terms of percentage by weight of protein, fat
and carbohydrates, the total number of calories per ounce, the num-
ber of calories contributed by carbohydrates and any carbohydrates
other them lactose, and the name of each ingredient entering into the
composition other than flavors. The artificially sweetened ice cream
shall not be sold in any quantity or in any manner other than
in a sealed or unbroken pint package or container.

(g)

(i) "Stabilizers" or emulsifiers are pure edible gelatins or vege-
table gums or any other wholesome edible materials and in such
amounts as may be approved by the State Board of Health.

(ii) "Artificial sweetener" is a pure edible product which is made
synthetically and has no caloric value. Provided, that nothing con-
tained in this definition shall be construed as barring any artificial
sweetener other than those mentioned in this law, which has been
demonstrated to be equally as efficient and which has been approved
by the State Health Authority.

(h) "Imitation ice cream" is any frozen substance, mixture or
compound regardless of the name under which it is represented,
which is made in imitation or semblance of ice cream, or is prepared
or frozen as ice cream is customarily prepared of frozen, and which
is not ice cream, artificially sweetened ice cream, ice milk, frozen
custard, sherbet, water ice or fruit ice or quiescently frozen confec-
tions and quiescently frozen dairy confections as they are defined in
this section.

193.

(a) Imitation ice cream shall not be sold, possessed, advertised or
offered or exposed for sale by anyone at any time.

No person shall advertise, possess, or expose for sale, or offer for
sale, any frozen or partially frozen product or compound made wholly
or partly out of milk, cream (with or without added milk solids or
added milk fats), sweetening agent, flavoring, with or without color-
ing, or eggs, if it shall contain any fat, oils, or paraffin, other than
milk fat, except such fat or oils as are naturally contained in the
flavor used.

Frozen dairy foods and ices mean any or all of the following: Ice
cream, artificially sweetened ice cream, frozen custard, sherbet, water
or fruit ice, and quiescently frozen confections and quiescently frozen
dairy confections and ice milk. Frozen dairy foods and ices mix
mean the mix used in the freezing of the above-mentioned frozen
foods and ices.

Sec. 2. And be it further enacted, That this Act shall take effect
September 1, 1963.
