ment), title "Governor—Executive and Administrative Depart-
ments," to follow immediately after Section 318 thereof and to be
under the new subtitle "28. Commission on Physical Fitness,"
creating the Maryland Commission on Physical Fitness, providing
generally for its powers, duties, operations, members, and person-
nel, conferring powers on certain political subdivisions with respect
to physical fitness, and relating generally to physical fitness in this
state.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Sections 319 to 325, inclusive, be and they are hereby added
to Article 41 of the Annotated Code of Maryland (1957 Edition and
1962 Supplement), title "Governor—Executive and Administrative
Departments," to follow immediately after Section 318 thereof, to
be under the new subtitle "28. Commission on Physical Fitness," and
all to read as follows:
28. Commission on Physical Fitness
319.
The Commission on Physical Fitness is created, hereinafter re-
ferred to as the "Commission," for the purpose of protecting and
improving the physical fitness of residents of this state.
320.
(a) The Commission consists of twenty-five members including
a Chairman, all to be appointed by the Governor. They shall be
selected because of their experience or interest in physical fitness for
both youth and adults. Members of the Commission shall serve with-
out compensation except that they may be reimbursed for necessary
travel and other expenses incurred in the performance of their duties.
(b) The first members of the Commission shall be appointed for
terms as follows: six members shall be appointed for terms of one
year each; six members shall be appointed for terms of two years
each; six members shall be appointed for terms of three years each;
six members shall be appointed for terms of four years each; and the
Chairman shall be appointed for a term of four years. As the term
of each member expires, his successor shall be appointed for a term
of four years except that each member shall serve until his successor
is appointed and has qualified.
(c) Commissioners are eligible for re-appointment. Upon the
death, disability, resignation, removal, or refusal to serve of any
Commissioner, the Governor shall appoint another qualified person
to the unexpired term.
321.
The Governor upon recommendation of the Commission shall ap-
point an Executive Director of the Commission. The Executive Di-
rector shall serve as Secretary of the Commission and is the chief
administrative and executive officer of the Commission, having gen-
eral charge of the work of the Commission under its direction.
