SUB-TITLE "FIREWORKS" BE AND THEY ARE HEREBY
REPEALED AND RE-ENACTED, WITH AMENDMENTS, AND
THAT NEW SECTIONS 18A TO 18E INCLUSIVE BE AND
THEY ARE HEREBY ADDED TO THE SAID ARTICLE AND
SUB-TITLE OF THE SAID CODE, TO FOLLOW IMMEDIATE-
LY AFTER SECTION 18 THEREOF AND ALL TO READ AS
FOLLOWS:

101. 15.

(a)  The term "fireworks" as used in this sub-title shall mean fire-
crackers, squibs, rockets, sparklers, Roman candles, torpedoes, bombs,
grenades, fire balloons, signal lights, and any combustible or ex-
plosive composition, or any substance or combination of substances,
or article prepared for the purpose of producing a visible or an
audible effect by combustion, explosion, deflagration, or detonation.
The term "fireworks" shall not include toy pistols, toy canes, toy
guns, or other devices in which paper caps containing twenty-five
hundredths grains or less of explosive compound are used, providing
they are so constructed that the hand cannot come in contact with
the cap when in place for use, and toy pistol paper caps which con-
tain less than twenty-hundredths grains of explosive mixture, the
sale and use of which shall be permitted at all times.

(b)  "Explosive composition" means any mixture or substance
which, upon being ignited may cause such a generation of highly
heated cases that the resulting gaseous pressures are capable of pro-
ducing destructive effects on contiguous objects.

(c)  "Fireworks plant" means and includes all lands, with build-
ings thereon, used for or in connection with the manufacture or pro-
cessing of fireworks.

(d)  "Production building" means any building or other structure
in which fireworks are manufactured or processed.

(e)  "Storage building" means any building or structure in which
fireworks in any stage of processing, or finished fireworks, are stored,
but in which no processing or manufacturing is performed.

(f)  "Magazine" means any building or structure used for the
storage of hazardous chemicals or powders.

(g)  "Warehouse" means any building or structure used exclusively
for the storage of inert materials.

(h) "Department" means the State Insurance Department of
Maryland.

(i) "Class A, B, or C Explosives" refers to the Classes so nomi-
nated and defined by the Interstate Commerce Commission.

102. 16.

(b) It shall be unlawful for any person to sell fireworks to any
person or persons without a permit issued under this sub-title [ex-
cept as hereinafter provided.] provided that nothing in this sub-title
shall be construed to prohibit the sale or delivery of fireworks by a
manufacturer licensed by the Department under the provisions of
this sub-title to bona fide distributors, jobbers, or wholesalers whose
principal place of business is situated in a state where the sale and/or
possession of such fireworks is permitted by law.
