and against the form of the Act of Assembly in such case lately made
& provided &c            Test Wm. Mc.Clean
On the Back of the afd Indictmt. was Indors'd as fol. Vizt.
           Billa Vera pr. John Brown Foreman
And now here to wit at Kent County Court at the Court house in
the Town of Chester in said County on the third tuesday of Novr.
being the fourteenth day of said month in the Year of Our Lord
Seventeen hundred thirty & eight Cometh the afd Lord propry by Tench
Francis his Attorney and prayeth that the afd Mary to the Indictt.
afd might Answer       And the afd Mary in her proper person
comes & defends the force & injury when &c And saith that she cannot
gainsay the Indictment afd so as afd against her brought nor can she
say but that she is guilty of the premisses afd above upon her Imposed
as by the afd Indictmt. it is Alledged & thereupon Submits to the Court
Therefore it is Considered by the Justices here to wit at Kent Coty
Court at the Court house in the Town of Chester in said County on the
third tuesday of Novemr. being the fourteenth day of said month in the
year of Our Lord seventeen hundred thirty & eight that the afd Mary
have on her bear back Eleven lashes well laid on untill the
blood do Appear as a punishment for Committing the fornication
afd Also it is Considered that the said Mary pay the sum of
two hundred and ninety nine            pounds of tobo. Costs accrueing
on the premisses afd to the Officers of this Court &c
Ordered by this Court here that the sher. of Kent County take into
his Custody the body of the afd Mary & Execute the punishmt. in the
Judgment afd Specified And afterwards to bring her into Court agn.
of which said precept the sd sher. to wit Simon Wilmer Gent. makes
return thereof to the Court here on the day & year afd last mentd.
that he hath Executied the punishmt. in the Judgmt. afd specified
and have her the said Mary here before the Court
Henry Anderson One of the afd Mary's Children being brought into
Court Thereupon Security to the County is to be given to keep the
afd Henry from the Charge of the Same                  Thereupon Doct[r.]
Alexr. Adair being prsent here in Court Acknowledgeth himself
Indebted unto his Lordship the right honourable the Lord
propry in the sum of five thousand pounds of tobacco to be

made
