his heirs and Successors With Condition to this Recognizance
that the afd John Swift makes his personall Appearance before
the Justices of Our next June Court then and there to Answer unto
Such things as Shall be Objected a give Evidence in behalf of
his Lordship against the afd Cornelius Then this recognizance
to be Void Else to remain in full force in Law       Jervis Spencer
The afd John Swift being Sworn to the Grand Jury of the afd
County Court on the day and year afd mentioned After which
the afd Jurors returns the following Indictment
Kent County fst The Jurors for the right honourable the Lord
propry that now is for the body of Kent County upon their
Oath do present that Cornelius Toby late of said County plantr.
on the first day of June Anno Dom. seventeen hundred thirty and
nine With force and Arms at the County afd in and upon a
certain John Swift in the peace of God and the said Lord propry
then and there being an Assault did make and him the said John
Swift did then & there beat wound and evilly treat & other
harms to him did to the great Damage of him the said John
Swift And against the peace of the said Lord propry his Good
rule & Government &c                           J George
On the Back of the afd Indictment was Indorsed as fol.
Vizt                  Billa Vera Jams. Ringgold foreman
And now here to wit at Kent County Court at the Court house
in the Town of Chester in said County on the third tuesday of June
being the nineteenth day of said month in the year afd cometh the
Lord propry by Joshua George his Attorney and prayeth that
the afd Cornelius to the Indictment afd may Answer
And the afd Cornelius in his proper person comes and
defends the force and injury when &c And siath that he cannot
gainsay the Indictment afd so as afd against him brought
nor can he say but that he is guilty of the premisses afd
above upon him Imposed as by the afd Indictment it is
Alledged and thereof with Protestation of his Innocency
