this day to the fourteenth day of Novemr in the year of Our Lord Seventeen hundred thirty & eight makes return that he hath here ready twelve &c by whom &c As by his precept he was Commanded And now here afterwards to wit the day and year last mentioned Come again the afd Lord Propry by his Attorney afd And the afd Henry in his proper person comes also And the Jurors of that Jury being Impannelled and called likewise come to wit Nathl. Hynson, Richd. Wilson, Benja. Belackistone, Thoms. Hatcheson, Hans Hanson Junr., Willm. Yearly, Thos. Bordley, Nathaniel Ricketts, John Reed, John Clark, Thomas Sanders, John Rason Who being duely elected tried & Sworn to Say the truth in the prsses the afd Henry Smith Appearing to the Verdict of the Jurors afd And upon their Oath do say that Henry Smith is Guilty as he stands Indicted and by Nathl. Hynson their foreman all so Say &c Therefore it is Considered by the Justices here to wit at Kent County Court at the Court house in the Town of Chester in said County on the third tuesday of Novemr. being the fourteenth day of said month in the year of Our Lord seventeen hundred thirty and eight that the afd Henry Smith shall stand in and upon the Pillary in the County afd for the Space of One hour And shall be whiped at the publick whiping post in the same County with fifteen Lashes upon the bare Back of him the same Henry and the blood to Appear And it is Commanded to the sherr. of Kent County that he do the Execution thereof upon him the said Henry immediately at his perrill &c And it is further Considered that the same Henry do pay unto Wm. Carmichaell the sum of two hundred & fifty pounds of tobo. being the four fold of the Value of the goods afd so as afd Stolen and that he the said Henry do return to the said William the afd goods or the Single Value and One half pound thereof being Sixty two pounds of tobacco ^ And he not having wherewithall to pay the four fold afd mentioned Thereupon he is Committed into the Custody of the sher. of Kent County untill the four fould afd be Satisfyed It is Also Considered by the Justices at the time and place afd that the same Henry pay the sum of Seven hundred Seventy & Seven pounds of tobo. Costs Accrueing on the premisses afd to the Officers of this Court &c Ordered by this Court here that the afd Henry give Security for the Fees afd Accrue: :ing on the premisses afd to the Officers of this Court And he having no One to Offer nor no One Offering for him thereupon he |
