Henry Smith	County afd upon their Oath do Present that

Henry Smith late of S^t. Pauls Parish in Kent County afd Labourer
the twenty first day of Novem^r. in the year of Our Lord Christ seven:
:teen hundred thirty and eight at the Parish afd in the County afd and
within the Jurisdiction of this Court One Silver Spoon of the value
of One hundred pounds of tobacco of the goods and Chattles of a
Certain William Carmichaell then and there being found then &
there feloniously did Steal take & bear away against the peace
of the same Lord Prop^ry his good rule and Government and Contrary
to the form of the Act of Assembly in Such case lately made and
Provided &c                  D Dulany p^r Dn^o. Prop^ry
On the Back of the afd Indictment was Indorsed as fol. Viz^t
                          Billa Vera Matthew Howard Foreman
And now here to wit at Kent County Court at the Court house
in the Town of Chester in said County on the third tuesday of
Novem^r. being the fourteenth day of said month in the year of
Our Lord seventeen hundred thirty & eight Cometh the afd Lord
Prop^ry by his Attorney afd and prayeth that the afd Henry
to the Indictment afd may Answer                  And the afd
Henry in his proper person comes and defends the force and
injury when &c And saith that he is in no Sort guilty of the p^rsses
Above upon him Imposed as by the Indictm^t. afd it is Alledged
And thereof he puts himself upon the Country &c And he who
followeth for the Lord Prop^ry in like manner Saith he is guilty
Thereupon Command was given to the sher. of Kent County
that he Immediately cause to come here twelve &c by whom &c
who neither &c to recognize &c because as well &c by which said
Precept the said Sheriff to wit Simon Wilmer Gent. now here at
