Then this Obligation to be Void Else to stand & remain in full force & Virtue in

Kent County fst The Jurors for the Right honourable the Lord propry that
now is for the body of Kent County afd upon their Oath do present that Charles
Fortescue late of St. Pauls Parish in the County afd Gent. the ninteenth
day of Novemr. in the year of Our Lord Christ seventeen hundred thirty &
eight at the Parish afd in the County afd and within the Jurisdiction of
this Court with force and Arms in & upon Mary Garnett the wife of George
Garnett in the peace of God and of the same Lord Propry then and there
being an Assault did make and her the same Mary did beat wound &
evilly treat so that of her life it was much dispaired & other harms
to her then & there did to the great damage of the same Mary & agst.
the Peace of the Same Lord Propry his good rule & Government &ca.

On the Back of the afd Indictmt. was Indorsed as fol. Vizt.
                 Billa Vera Matthew Howard Foremn. Gd. Jury
And now here to wit at Kent County Court at the Court house in the
Town of Chester in said County on the third tuesday of Novemr. being
the fourteenth day of said month in the year of Our Lord One thousd.
seven hundred thirty & eight Cometh the afd Lord Propry by his
Attorney afd and prayeth that the afd Charles to the accon. afd may
answer                  And the afd Charles in his Proper person
comes and defends the force & injury when &c And saith that he
cannot gainsay the Indictmt. afd so as afd against him brought nor
can he say but that he is guilty of the Premisses afd above upon him
Imposed as by the Indictmt. afd it is alledged and thereof Submits
to the Court &c Therefore it is Considered by the Justices here
to wit at Kent County Court at the Court house in the Town of Chester
in said County on the third tuesday of Novemr. being the fourteenth day
of said month in the year of Our Lord seventeen hundred thirty and
eight That the afd Charles pay the Sum of One pound ten shil.
Current money of Maryld. as a Fine for Committing the Offence afd
Also it is Considered by the Justices at the time & place afd last
mentioned that the said Charles pay the sum of three hundred and
eighty One Pounds of tobacco Costs Accrueing on the Premisses afd
to the Severall Officers of this Court &c
Ordered by the Court here that the fine afd be delivered to the sherr. of
Kent County The afd Charles not having whereall to Satisfy the fine afd
nor no One Offering to pay it for him Thereupon he is Committed
into the Custody of the Sherr. of Kent County untill the fine afd be
Satisfyed It is Also Ordered by this Court here that the afd Charles
give Security for the Fees afd Accrueing on the premisses afd to
the Sevall Officers of this Court &c And he having no One to Offer
nor no One Offering for him Thereupon he is Committed into
the Custody of the Sher. of Kent County untill he give Security as afd
