On motion of Mr. Ford, of Cecil,
The Sergeant-at-arms was sent to summon the absent
members:
After some time the Sergeant-at-arms returned, and an-
nounced that he had summoned the absentees;
On motion of Mr. Goldsborough,
Further proceedings under the call were dispensed with;
Mr. Stirling proposed the following amendment:
Sec. 3. Strike out and insert,
"That the Baltimore and Ohio Rail Road Company, shall
deliver to the several companies hereafter mentioned, to
whom the said stock may be delivered under this act, the un-
paid extra dividend declared on the 17th December 1856, so
soon as the court of last resort to which the question may be
submitted, shall decide the said extra dividend to be valid
and binding on the said company, and authorised by its char-
ter. And nothing in this act contained shall be construed,
to direct the discontinuance or withdrawal of any suit now
pending and undecided, either at the instance of the State of
Maryland, or of the city of Baltimore, to test the validity of
the said extra dividend;
