832          JOURNAL OF PROCEEDINGS         [March 8,

penalty of one hundred dollars for each and every day of such
failure or non-payment, to be recovered according to law;"

Which was adopted.

"Section 4. And be enacted, That the manner, time and
place for opening said books shall be as follows, namely:
Within ten clays after the passage of this act, the said per-
sons herein named as corporators, shall appoint one commis-
sioner, the acting mayor of Baltimore city one commissioner,
and the said two commissioners the third commissioner; and
in case of vacancy from any cause, after the said appointments
are made as aforesaid, the remaining commissioners shall fill
the same from time to time as any vacancy may occur; and
the said commissioners shall constitute a board to open said
books to receive the said subscriptions to said capital stock,
as hereinafter described.
