434              JOURNAL OF PROCEEDINGS [Feb. 16,

Mr. Briscoe proposed the following amendment:

Additional section: ''For every apprehension and convic-
tion of a hawker or pedlar, the sheriff, constable, or any
other person apprehending, shall be entitled to receive tile
sum of fifty dollars, to be recovered before a justice of the
peace, for the use of the county school fund; that none of the
preceding sections of this act shall apply to religious societies,
except those contained in its first section, and that no fees or
tax be exacted of them."

Mr. Jacobs proposed the following substitute:

"Be it enacted, That no license for hawking and pedling
shall hereafter be granted, and every person engaged in the
business in violation of this act shall be deemed guilty of
felony, and liable to all the punishments inflicted on felons;"

Which was lost.

The question then recurred on the amendment proposed by
Mr. Briscoe;

Pending the consideration thereof.
On motion of Mr. Mackubin,

The House adjourned until to-morrow morning, at ten
o'clock.

THURSDAY, February 16, I860.

The House met pursuant to adjournment, and was opened
with prayer by the Rev. Mr. Thrush.
