"And be it enacted, That as much of the act passed at De-
cember session 1840, chapter 23, entitled, "an act to provide for.
the valuation and assessment of the property of this State, and to
pay the debts of the State" as imposes a tax on mortgages, be
and the same is hereby repealed;"
