be compelled to render accounts of the emoluments of their sev-
eral offices to the Comptroller of this State, as required by the
2nd section of the act of 1853, ch. 444; provided each of" said
officers shall make oath or affirmation, as the case may be, that
the emoluments of his office do not amount to the sum of twenty-
five hundred dollars, annually, after deducting expenses necessa-
rily incident to said office.

Section 2. And be it enacted, That each of said officers shall
render to said Comptroller, annually, an account under oath or
affirmation, of the necessary expenses of his office, and if the
Comptroller, upon examination, shall consider the account of ex-
penses affixed to be greater than it, in his judgment, should be,
he shall then order a full compliance with the law affixed by said

Office.                                                                   

Section 3. And be it enacted, That whenever the Comptroller
of this State shall be of opinion that the expenses returned by
any of the officers named in the first section of the aforesaid act
of 1853, are larger than they should be, with due regard to the
interest of the State, he shall direct the State's Attorney of the
county or city in which said officer shall reside, to sue his official
bond, which shall be responsible for the said unnecessary charge
in his expenses, and the amount of such unnecessary charge,
when ascertained upon trial, shall be collected and paid into the
Treasury of this State.                                                 

Amendments assented to.                        

Also offered the following amendment:                   

"Section 4th. And be it enacted, That the provisions of this
act are not intended to relieve said officers from any responsibili-
ty under the law of 1853, chapter 444, other than herein, speci-
fied;"
