way, lane or alley in Hagerstown or any part thereof, to pay
as therein set forth, the cost of grading, making, paving, con-
creting, macadamizing and curbing, or for regrading, remak-
ing, repaving, reconcreting remacadamizing and recurbing of
any such streets, highways, lanes or alleys of said city; mak-
ing the cost thereof a lien on said property; providing for the
collection thereof, requiring the Mayor and Council in its
discretion to pay for a certain portion of the costs of the
work done and the materials used on said streets, highways,
lanes or alleys, and to provide for the payment thereof by said
city; for all gas, water or other companies desiring to lay
mains in said streets and all persons or corporations owning
property abutting thereon desiring to make service connec-
tion to said mains, shall do so within a prescribed time as set
out in said ordinance; and for requiring all railroad com-
panies occupying said streets with its tracks to grade, make
and pave and to regrade, remake and repave the space between
its rails arid two feet on the outside thereof and to maintain
the same, providing a penalty for the failure of, said railway
companies to comply with the provisions of said ordinance
applicable thereto. " [Which was read the first time and re-
ferred to Senators Bomberger, Kaufman and Warfield. ]

By Mr. Bomberger: Senate Bill No. 387, entitled "An Act
to authorize and empower the Mayor and Council of
Hagerstown to acquire by purchase or condemnation a cer-
tain tract or tracts of land, with the improvements thereon,
abutting on and along both sides of a stream of water for its
entire length, commonly called and known as 'Marsh Run, ' in
Hagerstown, Maryland; the entire stream of water known as
'Marsh Run, ' from the eastern boundary of the property of
the Hagerstown City Park to the Antietam creek, together
with all rights, easements, privileges and ways of all persons
and corporations therein and any and all streams of water,
waterways, water courses, drains and sewers emptying into
said Marsh Run, and all rights, privileges, easements and
ways of all persons and corporations therein, without the
necessity of submitting the purchase or the award or the
ratification thereof to the qualified voters of Hagerstown;
the same, when so acquired, to be used for drainage pur-
poses for Hagerstown; providing means of payment there-
for and authorizing and empowering the Mayor and Coun-
cil to dispose of any part of said tract or tracts of land
so acquired, which in its opinion may be unnecessary for said
