ter county, Maryland, connecting the headwaters of the Little
Blackwater River with the headwaters of Cambridge Creek,
so as to connect the navigable waters of the Little Blackwater
River with the navigable waters of the Great Choptank River
through Cambridge Creek; and to regulate, levy and collect
tolls or charges for the use of said canal; and to own, use
and operate vessels, barges and other appliances in, through,
or in connection with said canal, and generally to do and
perform all such acts and things, and make all such agree-
ments and contracts as may be necessary for the objects and
purposes of the construction, ownership and operation of said
canal, or of any business connected therewith.

'Sec. 3. And be it enacted, That the said company shall
" have the right and power to determine the width, course and
depth of said canal, which shall not exceed forty feet (40) in
width on the surface at mean low water, and shall have a
depth of not less than five (5) feet at mean low water, to
contract for and acquire the right-of-way over and through
the lands where the said canal may run, or be constructed,
provided that if said land, right-of-way, easements or any of
the property necessary for the construction, ownership and
operation of said canal cannot be acquired and secured by
agreement with the owner or owners thereof, or any part
thereof, or if the owner or owners, or any of them, be a feme
covert, under age, non compos mentis, out of the county in
which the property needed or required may be located when
or at the time the same may be needed, or if for any reason
whatever the said company cannot obtain or acquire the
land, right-of-way, easements or property necessary for the
construction, ownership and .operation of said canal, the said
company shall have the right and power to acquire the same
by condemnation in the manner now provided by the Code of
Public General Laws of Maryland; and provided, further,
that the said company shall not only have the right and power
to secure and acquire by contract, gift, purchase, deed, con-
veyance of any kind, or condemnation proceedings the land,
right:Of-way, easements or property necessary for the con-
struction, ownership and operation of .said canal channel
proper, of the dimensions hereinbefore set forth, but the said
company shall also have the right and power to secure and
acquire by contract, gift, purchase, deed, conveyance of any
kind, or condemnation proceedings, as hereinbefore set forth,
a strip of land on each side of said canal not to exceed forty
(40) feet in width, and to run along with, bind on and border
upon each side of the said canal channel proper, the said strips
