128. THE BOARD OF COUNTY COMMISSIONERS SHALL
ONLY USE THE SAID CONTINGENT FUND FOR THE PUR-
POSE OF MEETING ANY DEMAND ON ACCOUNT OF ANY
ESTIMATE FOR WHICH THERE MAY BE NO MONEY AT THE
TIME IT IS NEEDED FOR THE PURPOSE OF THE ESTIMATE,
AND WHEN THE REVENUE FOR THE ESTIMATE SHALL
HAVE BEEN RECEIVED, IT SHALL BE CREDITED TO THE
CONTINGENT FUND.

Sec. 2. And be it further enacted. That this Act shall take effect
March 1, 1962.

CHAPTER 583
(House Bill 899)

AN ACT to repeal and re-enact, with amendments, Section 300 of
Article 66C of the Annotated Code of Maryland (1957 Edition),
title "Natural Resources", sub-title "Fish and Fisheries. Part 2.
Tidal Waters", sub-heading "License to Operate Nets and Seines",
relating to lapse of commercial net fishing licenses for non-use
of the license.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 300 of Article 66C of the Annotated Code of Maryland
(1957 Edition), title "Natural Resources", sub-title "Fish and Fish-
eries. Part 2. Tidal Waters", sub-heading "License to Operate Nets
and Seines", be and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:

300. Licenses to operate nets granted under the authority of this
sub-heading shall expire on December 31st of each year, but shall be
renewable annually to the person named therein, unless revoked or
suspended for cause, provided application for renewal for the en-
suing year be filed on or before December 1st of the preceding year.
If any person shall fail to make a bona fide use of his license during
any [two] four consecutive license years, the license shall lapse and
shall not be renewed. Provided, however, that no license shall lapse
if the licensee fails to renew or make bona fide use of his license
because of induction or enlistment into the armed forces or employ-
ment in essential war industries and such licensee makes application to
the Commission for the renewal of his license within one year of the
termination of hostilities or from the date of his release from the
armed forces; and provided, further, that if a licensee shall, at any
time during the war emergency, be unable to fish all the nets for which
he was licensed because of some condition arising out of the war, he
shall not, in consequence thereof, be deprived of his right to license
such nets thereafter.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961.
