(House Bill 326)

AN ACT to repeal and re-enact with amendments Section 55 (a) of
Chapter 780 of the Acts of 1959, this Act having enacted the sub-
title "Park and Planning Commission", having added this sub-
title to the Montgomery County Code (1955 Edition), being Article
16 of the Code of Public Local Laws of Maryland and having also
added this sub-title to the Code of Public Local Laws of Prince
George's County (1953 Edition) being Article 17 of the Code of
Public Local Laws of Maryland, said Section 55 (a) being in sub-
title "Metropolitan District", to provide that in Montgomery County
the County Council may request the Maryland National Capital
Park and Planning Commission to furnish an estimate of un-
expended balances at the end of a fiscal year in time for the tax
levy resolution.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 55 (a) of Chapter 780 of the Acts of 1959, this Act
having enacted the sub-title "Park and Planning Commission", hay-
ing added this sub-title to the Montgomery County Code (1955 Edi-
tion) , being Article 16 of the Code of Public Local Laws of Maryland
and having also added this sub-title to the Code of Public Local Laws
of Prince George's County (1953 Edition), being Article 17 of the
Code of Public Local Laws of Maryland, said Section 55 (a) being
in sub-title "Metropolitan District", be and it is hereby repealed
and re-enacted with amendments, to read as follows:

55 (a).

At least thirty (30) days prior to the ends of the fiscal years of
Montgomery and Prince George's counties, respectively, the Com-
mission shall certify and submit to the appropriate fiscal officers of
said counties the net unexpended balances in the hands of the Com-
mission from monies received by the Commission from Park Taxes
theretofore levied by said counties respectively, as provided else-
where in this sub-title. In Montgomery County, the Commission
shall also furnish at the time requested by the Council an estimate
of unexpended balances as of the end of the County fiscal year as in-
formation for the tax levy resolution.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961.
