of Article 81 of the Annotated Code of Maryland (1957 Edition),
title "Revenue and Taxes," sub-title "Tax Sales," sub-heading "In
General," amending the law concerning the expenses of tax sales
and changing the auctioneer's fee in certain counties for making
sales of property under the laws on the sale of
property for unpaid
taxes.
REVISING THE PROVISIONS IN THE TAX SALE
LAWS CONCERNING THE EXPENSES TO BE ALLOWED
THEREON.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 76 (g) of Article 81 of the Annotated Code of Mary-
land (1957 Edition), title "Revenue and Taxes," sub-title "Tax
Sales," sub-heading "In General," be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

76.

(g) The expense of publication of all notices relating to the sale,
the cost of the county or city surveyor's description and plat, if
necessary, a fee to the attorney representing the county treasurer
for services in connection with said sale not exceeding [ten dollars

($10.00)] fifteen dollars ($15.00) for each property, but in Balti-

more City or any county which has paid full time solicitor, counsel

or attorney, the said fee shall be collected and paid into the general

funds of the city or county, or, in Garrett County, the attorney's
fees for services as herein provided, the auctioneer's fee for making
the sale, which said auctioneer's fee in no case shall [exceed two

(G) THE FOLLOWING EXPENSES RELATING TO THE
SALE SHALL BE ALLOWED, ALL OF WHICH SHALL BE
LIENS ON THE PROPERTY TO BE SOLD:

(I)  THE EXPENSE OF PUBLICATION OF ALL NOTICES.

(II)   THE COST OF THE COUNTY OR CITY SURVEYOR'S
DESCRIPTION AND PLAT, IF NECESSARY.

(III)   A FEE TO THE ATTORNEY REPRESENTING THE
COUNTY TREASURER FOR SERVICES, NOT EXCEEDING
FIFTEEN DOLLARS ($15.00) FOR EACH PROPERTY; EX-
CEPT THAT IN BALTIMORE CITY OR ANY COUNTY WHICH
HAS A PAID FULL-TIME SOLICITOR, COUNSEL OR AT-
TORNEY, THIS FEE SHALL BE COLLECTED AND PAID INTO
THE GENERAL FUNDS OF THE CITY OR COUNTY.

(IV)  THE AUCTIONEER'S FEE, WHICH IN NO CASE SHALL
EXCEED TEN DOLLARS ($10.00) FOR ANY DAY WHEN ONE,
TWO OR THREE PROPERTIES ARE SOLD; AND FOR ANY
DAY WHEN FOUR OR MORE PROPERTIES ARE SOLD THE
FEE SHALL BE THREE DOLLARS ($3.00) FOR EACH PROP-
ERTY SOLD.

one, two or three properties are sold, and where four or more prop-

erties are sold on any date the fee shall be three dollars ($3.00) for

each property sold; and in Baltimore and Cecil counties where pro-
vision has been hereinbefore made for the posting of the premises

to be sold, there shall be allowed a sum not in excess of seven dollars

and fifty cents ($7.50) for said service, and the expenses of con-
ducting the sale shall be liens on the property to be sold.
