persons taking soft shell clams in the county, and to provide penal-
ties for violation.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 715 (b) be and it is hereby repealed and re-enacted,
with amendments, and that new Section 715B be and it is hereby
added to Article 66C of the Annotated Code of Maryland (1957 Edi-
tion and 1960 Supplement), title "Natural Resources", sub-title
"Oysters and Clams", new Section 715B to follow immediately after
Section 715A, and to read as follows:

715(b).

Somerset, Kent, Charles and St. Mary's counties.—It shall be un-
lawful for any person, firm or corporation to take, catch or dredge
soft shell clams (myra arenaria) from any county waters of [Somer-
set,] Kent, Charles and St. Mary's counties by the use of any hydraulic
or mechanical dredges. Any such person, firm or corporation so doing
shall, upon conviction thereof before any justice of the peace, be fined
$500.00 and costs.

715B.

(a)   How to Apply for Hydraulic Dredge License.Any person
wishing to take or catch soft shell clams (myra arenaria) with any
hydraulic or mechanical dredge or rig in the waters of Somerset
County or the waters of the Chesapeake Bay adjacent thereto shall
apply to the Department of Tidewater Fisheries either by mail or in
person for an application for a hydraulic or mechanical dredge or
rig license. Every such applicant shall exhibit to the Department
satisfactory evidence showing the name or number and size of the
boat or rig; the size of the blade, water manifold and conveyor or
elevator on the boat or rig to be used, and make further oath or
affirmation that he is the bona fide owner of such boat; that there is
no lien on said boat held by a nonresident of Maryland; that he has
been a resident of Somerset County for at least one year prior to the
making of such application, and that the information he has furnished
concerning the rig is true.

(b)   Issuance of License and Duration.Upon the receipt of the
application and upon making such oath, the Department shall issue a
hydraulic or mechanical dredge license for the taking of soft shell
clams for such boat or rig and shall receive therefor twenty-five
dollars ($25.) as a license fee. Licenses issued hereunder shall be
valid for twelve (12) months from July 1st to June thirtieth of each
year.

(c)   Residence of Master and Crew.(1) the master, captain,
operator and crew of such hydraulic or mechanical dredge shall have
been a bona fide resident of Somerset County for a period of one year.

(2) The master, captain or operator of any hydraulic or mechan-
ical dredge shall be the actual owner thereof, or a member of the
immediate family of the licensee.

(d)   Transfer of License Upon a Sale.It is lawful for the owner
of any licensed hydraulic or mechanical dredge, boat or rig, whenever
the owner shall sell and convey by bill of sale for a bona fide con-
sideration such boat or rig to any person, who has been a resident of
