Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961.

(House Bill 24)
AN ACT to repeal and re-enact, with amendments, Section 161 of
Article 93 of the Annotated Code of Maryland (1957 Edition),
title "Testamentary Law", sub-title "Orphans' Court" "DISTRI-
BUTION", amending the testamentary laws of the State with
regard to a legatee, distributee or beneficiary of a trust or other
testamentary disposition who is a nonresident of the United States,
in order to provide for the contingency that moneys due to any
such person are unclaimed after a period of seven (7) years.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 161 of Article 93 of the Annotated Code of Maryland
(1957 Edition), title "Testamentary Law", sub-title "Orphans' Court"
"DISTRIBUTION", be and it is hereby repealed and re-enacted, with
amendments, to read as follows:
161.
(a) Where it shall appear that a legatee, distributee or beneficiary
of a trust or other testamentary disposition is a nonresident of the
United States of America and would not have the benefit or use or
control at its full value of money or other property comprising such
legacy, distributive share, benefit or trust, or where other special
circumstances make it appear desirable that payment or delivery
should be withheld because of national or international action (other
than action by the United States of America) affecting such money,
property or value or the full use and enjoyment thereof, the orphans'
court or any other court having jurisdiction of the estate or trust
may direct that such money or other property shall be paid or
turned over to the register of wills or the clerk of the court for the
ultimate benefit of such legatee, distributee or beneficiary or such
person or persons as may thereafter appear to be entitled thereto,
to be paid or delivered to him or them only when and as it shall be
established that such party will personally fully enjoy the advantage
and benefit thereof. Such money or other property so paid into
court shall be paid out or delivered only by the special order of the
orphans' court or of any other court having jurisdiction.
(b) Upon the expiration of a period of seven (7) years from the
date of the deposit of any such money or other property with the
register of wills or the clerk of the court, and if no such claimant
or claimants have appeared and made claim for the money or prop-
erty within this period, the money or property is and becomes pay-
able to the board of county commissioners or county council of the
county, or to the mayor and city council of Baltimore, for the use
of the public schools of the county or City, as the case may be, after
due compliance by the register of wills or the clerk of the court with
the provisions of Section 210 21 of Article 16 of this Code.
