540                              Laws of Maryland                       [Ch. 407

County (1957 Edition, being Article 14 of the Code of Public
Local Laws of Maryland), title "Howard County", sub-title "Fire
Protection", permitting special tax levies in Howard County for
capital improvements by volunteer fire companies, and specifying
certain procedural requirements for such tax levies and their use.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 113 (b) (1) and 113 (b) (3) of the Code of Public
Local Laws of Howard County (1957 Edition, being Article 14 of the
Code of Public Local Laws of Maryland), title "Howard County",
sub-title "Fire Protection", be and they are hereby repealed and re-
enacted, with amendments, to read as follows:

113 (b).

(1) Said volunteer fire company or companies for whose benefit
said special tax is levied shall have filed with said County Commis-
sioners on or before the first day of September, next preceding their
annual levy, a petition, duly executed by an appropriate officer of
said company, requesting that said special district tax be levied in
the district wherein the petitioning volunteer fire company is located
and setting forth the amount which the petitioning company deems
will be necessary to acquire by said special district tax for its oper-
ating and maintenance expenses and for capital improvements for
the ensuing calendar year. Said petition shall be accompanied by a
current financial report of the petitioning company and also by a
proposed budget for the ensuing calendar year setting forth in detail
its anticipated operating and maintenance expenses and amounts
necessary for capital improvements.

(3) No amounts, or any part thereof, realized from any such
special district tax in any particular election district shall be used
for any purpose other than for the operating and maintenance
expenses of the volunteer fire company located within said particular
election district; provided, however, that said County Commissioners
may, in their discretion, specifically authorize the use by any volun-
teer fire company of all or any designated part of such amounts for
capital improvements.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961.
