cotic drug , OR DANGEROUS DRUG AS DEFINED IN SECTION
307 OF THIS ARTICLE, except upon written prescription of the
regularly appointed physician thereof, with the intent that a convict
shall obtain or receive it, and whoever receives from a convict
ANY-
THING TO EFFECT THE ESCAPE OF A PRISONER OR IN-
MATE LAWFULLY DETAINED THEREIN, any intoxicating
liquor,
BEVERAGE, stimulating sedative , or narcotic drug , OR
DANGEROUS DRUG AS DEFINED IN SECTION 307 OF THIS
ARTICLE with the intent to convey it out of the institution without
written permission of the Superintendent of Prisons or the officer in
charge of said penal institution or place of confinement, shall be
guilty of a misdemeanor and shall be punished by imprisonment for
not more than three years, or by a fine not to exceed $1,000.00, or
both.

Sec. 2. And be it further enacted, That this Act is hereby de-
clared to be an emergency measure and necessary for the immediate
preservation of the public health and safety, and having been passed
by a yea and nay vote supported by three-fifths of the members
elected to each of the two houses of the General Assembly, the same
shall take effect from the date of its passage.

CHAPTER 331

(Senate Bill 351)

AN ACT to repeal and re-enact, with amendments, Section 578 of
Article 27 of the Annotated Code of Maryland (1957 Edition),
title "Crimes and Punishments", sub-title "Trespass", relating to
the offense of hunting birds and game on private property in the
State, establishing the liability of the hunter and the landowner,
and providing penalties for violations.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 578 of Article 27 of the Annotated Code of Maryland
(1957 Edition), title "Crimes and Punishments", sub-title "Tres-
pass", be and it is hereby repealed and re-enacted, with amendments,
to read as follows:

578.

Any person who shall hunt with a gun any wild game birds or
wild game animals upon private property without first obtaining the
permission of the landowner or his agent shall be guilty of a mis-
demeanor and upon conviction thereof shall be liable to a fine of not
more than one hundred ($100.00) dollars [; however, the provisions
of this section shall apply only to Montgomery and Frederick Coun-
ties]. Any such person hunting on such private property shall be
liable for any damage
